US Federal Communications Commission is Hiring an ATTORNEY ADVISOR (HEARINGS) Near Washington, DC

Duties

Are you skilled in written advocacy? Do you enjoy building a case through interrogatories, document requests, and depositions? Put those litigation skills to good use and come join the Hearings team in the Enforcement Bureau’s Investigations & Hearings Division (IHD)!

In addition to the work IHD does conducting investigations and taking enforcement actions across a broad range of issues involving virtually all services subject to FCC jurisdiction, IHD also serves as trial staff for all administrative hearings conducted before a Commission administrative law judge or other presiding officer pursuant to 5 U.S.C. § 556 of the Administrative Procedure Act.

The FCC’s administrative hearings – which are often conducted on a written record – require strong advocacy skills and creative thinking. These hearings address complex issues that can have an important impact on major industry parties; and that can be of intense public interest. These hearings frequently address issues such as the qualifications to hold a Commission license; whether a licensee has violated Commission rules; and whether a broadcast station has engaged in conduct that serves the public interest, convenience, and necessity.

The open position offers the opportunity to work as part of a team (1) developing case strategy; (2) conducting legal research and analysis; (3) drafting comprehensive legal documents such as memoranda, procedural motions, and substantive case briefs; (4) investigating key factual and legal issues; (5) preparing interrogatories and requests for documents; (6) interpreting applicable law and policy and documents and information received in response to information requests; (7) taking depositions; (8) appearing before the administrative law judge or other presiding officer; and (9) negotiating case resolutions.

The open position is responsible for interpreting the Federal Rules of Civil Procedure, the Federal Rules of Evidence, and/or similar administrative and appellate rules and procedures, and the Commission’s rules, regulations, and policies.

The open position is responsible for keeping abreast of legal developments affecting enforcement issues related to broadcast and wireless licenses and legal authorizations to operate through a review of court and Commission decisions, professional publications, and trade press. Communications law experience is not required.

Qualifications

Applicants must meet eligibility and qualification requirements by the closing date of this announcement. Current Federal employees must meet time-in-grade requirements by the closing date of this announcement.
Professional law experience is experience that has equipped the applicant with the particular knowledge, skills, and abilities to perform successfully the duties of the position and is typically in or related to the work of the position to be filled.

In order to be deemed as "BEST QUALIFIED" candidates must meet both the educational requirements AND the Specialized Experience.

A. Education

You must meet the minimum basic educational requirements for Attorney positions. Education requirements include: a professional law degree JD, LL.B., and/or LL.M.

NOTE-If you do not provide a transcript at the time of application, a transcript will be required to be provided at the time of selection.

B. Specialized Experience

For GS-15: Applicants must possess at least four years of professional law experience and at least one year must be equivalent to the GS-14 level in the Federal Service. For this position, examples of specialized experience includes:

  • Preparing for and/or conducting or participating in civil, criminal, or administrative trials/proceedings.
  • Drafting comprehensive legal documents such as memoranda, requests for documents and interrogatories, procedural motions, and case-determinative briefs.
  • Analyzing, interpreting, and presenting recommendations on complex and novel legal issues presented in documents and information received in response to information requests and in other parties’ procedural and substantive motions and briefs.
  • Providing advice and guidance on the Communications Act, the Commission’s rules, regulations, and policies, the Federal Rules of Civil Procedure, the Federal Rules of Evidence, and/or similar administrative and appellate rules and procedures.
  • Making oral presentations, communicating legal research results and case recommendations, and defending legal positions at all levels of authority.
  • Interacting with individuals at all levels of authority.

PART-TIME OR UNPAID EXPERIENCE: Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience.
