Description: The Investigator/ EEO Compliance Administrator ensures that applicants and employees are given equal opportunities in employment regardless of race, religion, color, national origin, sex, age, disability, or any other protected characteristic. Investigates internal and external agency complaints of violations of LYNX’s policies, including EEO and sexual harassment policies; delivers EEO training. This position is designated as the Agency’s EEO Officer and has dotted line direct access to the Chief Executive Office over all matters regarding the agency’s EEO program to maintain the checks and balances.Essential Functions:Investigates complaints of policy violations including Equal Employment Opportunity and Sexual Harassment policies and laws filed through internal processes or externally through the Equal Employment Opportunity Commission, Florida Commission on Human Relations, or Federal Transit Administration.Maintains compliance with and interprets Federal (EEO Circular 4704.1A, 49 CFR Part 27 etc.), State and local laws, including LYNX policies and procedures, related to EEO and the LYNX EEO Program in response to inquiries from departments, employees, applicants, and the public.Conducts and investigates complaints of discrimination, harassment, and retaliation from employees, applicants, and the public. Works with employees and supervisors/managers to address issues that are identified. Mentors and assists management with investigations and documentation related to investigation close outs.Possess the authority to independently assign EEO investigations to an outside investigation firm to ensure the impartiality of the EEO Officer and to avoid potential conflicts of interest in complaint investigations that may arise. Coordinates directly with outside labor/employment counsel who provides direct legal guidance and advice to EEO Officer regarding discrimination claims, discrimination laws, statutes, policies, and requirements pertaining to the EEO Program, federal regulations, and The Civil Rights Act. Maintains impartiality when independently investigating and determining the outcome of EEO complaint investigations.Assists in providing on-going monitoring and analysis of the agency’s hiring patterns and trends including the review and concurrence on all hires and promotions to ensure non-discriminatory practices.Assists management in collecting and analyzing employment data, identifying problem areas, setting goals and timetables, and developing programs to achieve goals. Designs, implements, and monitors internal audit and reporting systems to measure program effectiveness and to determine where progress has been made and where proactive action is needed. Assists with the implementation of policy and procedural modifications, the valuation of impact on divisions or departments, and the development of implementation plans.Assists in the design of recruitment resources; establishes and maintains working relationships with a diverse group of professional and community-based organizations; promotes targeted recruitment outreach activities to ensure that the hiring goals and timetables are achieved; monitors the effectiveness of various outreach resources., In collaboration with human resources, advises employees and applicants of available training programs and professional development opportunities and the entrance requirements.Conducts periodic EEO training for employees, supervisors, and managers; provides guidance to employees, supervisors, and managers. Reviews the agency’s nondiscrimination policy with all managers and supervisors to ensure that the policy is understood. Provides periodic reports to the Chief Executive Officer, at least semiannually, on the progress of each department in relation to the agency’s EEO goals and serves as a check and balance on employment practices of the agency.Participates and stays current in ongoing EEO investigative training that focuses on the important aspects of investigations such as issue spotting, planning, reviewing of documents, analyzing evidence, interviewing witnesses, and making investigations. Plans, completes, and files required EEO and/or affirmative action reports and documentation with government agencies, including the Federal Transit Administration. Reports survey results, statistics, and recommendations for corrective action to the appropriate stakeholders.Pursuant to established documentation procedures, records discriminatory factors and corrective actions identified through investigations of employment practices or alleged violations. Ensures timely processing and review of complaints by coordinating, monitoring, creating, and streamlining complaint procedures.Serves as a liaison between the agency; Federal, state, and local governments; regulatory agencies; and community groups representing minorities, women, and persons with disabilities. Audits positing of the EEO Policy statement to ensure compliance information is posted and up to date. Performs other duties as may be required or assigned. Required Qualifications:Bachelor’s degree from a regionally or nationally accredited institution in Business Administration, Public Administration, Human Resources, Psychology, or a closely related field plus four years of workplace investigation and EEO administration experience; or the equivalent combination of related education, training, and experience. Knowledge, Skills, and Abilities (KSAs):Knowledge of basic principles and practices of program development and implementation.Knowledge of basic principles and techniques of mediation, fact-finding and investigation required to resolve complaints.Knowledge of Federal, State and Local laws, codes, and regulations related to equal employment opportunity.Ability to analyze situations and adopt an effective course of action.Ability to demonstrate independence and impartiality to ensure no conflicts of interest occur with respect to the EEO Officer’s role in the agency. Ability to read and comprehend federal regulations and have sensitivity to the varied ways in which discrimination occurs.Ability to ensure quality control/proofread/edit and focus on detail and accuracy of work.Ability to operate a personal computer and various office machines.Proficiency in Microsoft Office programs including Outlook, Word, and Excel.Ability to work independently with little direction; initiate, organize, and follow up on work.Ability to exhibit a professional, courteous demeanor.Ability to work in a diverse environment. Excellent communication and interpersonal skills, including the ability to establish and maintain positive working relationships with those encountered in the course of work using principles of excellent customer service.Work Environment and Special Considerations:Works in an office environment. Must possess and maintain a valid Florida driver’s license and safe driving record. LYNX provides the community with much needed public transportation, and it is important for the Agency to resume its services as quickly and as safely as possible in the event of any natural, technological, or human-caused emergency or disaster. This position is considered a mission critical member of LYNX’s emergency preparation and response efforts during an emergency or disaster and as such, may be asked to work during these emergencies or disasters.“Rate will be determined by qualifications of candidates who exceed the minimum requirements.” Salary Range: $62,108.80 - $79,622.40 annual
