About the division:
The Division of Legal Services is within the Central Services Administration and provides support to all agency divisions at all employee levels to mitigate risks, comply with changing laws, and assist the agency in accomplishing its goals.
About the position:
The ADA Compliance Officer manages the agency’s Americans with Disabilities Act (ADA) Title II and Section 1557 nondiscrimination compliance program. The position is primarily responsible for intake, investigation, and resolution of discrimination complaints and client requests for ADA accommodations to ensure equal access to HCA programs and services. This position plays a vital role in reducing agency risk by facilitating equitable access to services, creating a legally sound and consistent process to manage ADA and other nondiscrimination matters, and by ensuring prompt and equitable resolution of complaints from clients, enrollees, or the public.
This position is eligible to telework and is typically not required to report on-site. The default assigned work location of all Health Care Authority (HCA) positions – both on-site and telework eligible positions – is within the State of Washington. Frequency of onsite work will vary based on business and operational needs. HCA may choose, but is not required, to support out-of-state telework on a case-by-case basis.

Duties

Some of what you will do:

  • Establish and manage a continuous ADA Title II and Section 1557 compliance, assessment, and evaluation program for HCA—working closely with internal ADA coordination staff and agency managers in all divisions.
  • Develop processes using Lean concepts for intake, investigation, and resolution of discrimination complaints and client requests for program ADA accommodations.
  • Develop and maintain good working relations with traditionally underserved or marginalized populations and those organizations which provide advocacy.
  • Serve as a representative on agency workgroups and assist the Chief Legal Officer with special projects to support agency initiatives.
  • Review and investigate complaints regarding discrimination and accessibility of HCA’s programs, services, and activities for individuals with disabilities.
  • Develop agencywide processes to evaluate ADA and Section 1557 compliance of state and federal laws through reviews and assessments and report on the results to leadership.
  • Maintain detailed correspondence and documentation of complaints, investigations, communications, issues, and findings.
  • Educate agency managers and staff on the importance of compliance with ADA and Section 1557.
  • Work with agency staff to implement requests for accommodation and alternate formats.
  • Manage multiple projects and assignments concurrently with a considerable degree of self-directed initiative.
  • Collaborate with the agency’s health equity team to ensure overall equity alignment across the agency.
  • Prepare formal and informal reports, memorandums, and presentations.

Qualifications

Required qualifications:
Qualifying candidates will satisfy one of the following requirement options:
Option 1:

  • Bachelor’s degree in behavioral health, public health, public administration, law, business administration, social work, or a related field and
  • Five (5) years of experience performing analysis and research, investigating, and resolving issues, and managing projects or business processes.
Option 2:
  • Associate degree in behavioral health, public health, public administration, law, business administration, social work, or a related field and
  • Seven (7) years of experience performing analysis and research, investigating, and resolving issues, and managing projects or business processes.
Option 3:
  • Nine (9) years of experience performing regulatory analysis and research, investigating, and resolving issues, and managing projects or business processes.
Note: Experience for both required and desired qualifications can be gained through formal professional employment, volunteer experience, lived experience, or a combination.
Required competencies:
  • Proven experience providing advice, guidance, and consultation demonstrating an expert level of knowledge of applicable laws, rules, and regulations.
  • Demonstrated experience using project management principles.
  • Continuous improvement skills including process improvement and use of feedback from clients and stakeholders to increase agency effectiveness and efficiency.
  • Strong organizational skills with the ability to work independently or in a team/project environment, handling multiple tasks and changing priorities while meeting deadlines.
  • Ability to exercise a high-level of emotional intelligence, critical thinking, and judgment during challenging or ambiguous situations.
  • Demonstrated ability to objectively assess processes and situations, recommend balanced and effective solutions from an objective viewpoint, and help others see the benefits of those solutions.
  • Demonstrated successful ability to lead efforts and work collaboratively to plan, analyze, and problem solve, identify policy needs, develop goals and objectives, and use data for decision making.
  • Ability to gain the confidence and trust of others through honesty, integrity, and authenticity. Excellent written and oral communication skills and demonstrated ability to communicate complex issues and unusual topics both verbally and in writing.

Preferred qualifications:
  • A law degree (J.D.) from an ABA accredited law school or a master’s degree above is highly preferred.
  • Experience performing regulatory analysis for Washington state government.
  • Advanced knowledge of laws applicable to the Americans with Disabilities Act is highly preferred.
  • Lean Six Sigma Certification
  • Handles customer service questions and complaints in a pleasant and professional manner.
  • Meets commitments, works independently, accepts accountability, maintains confidentiality, and stays focused under pressure.
  • Experience developing training and public presentations.
  • Ability to lead, direct, provide guidance to a diverse workgroup, and build consensus in a high-pressure political environment.
  • Strong organizational knowledge including how high-performing organizations succeed; principles of administration; effective problem solving techniques; project management; and performance management discipline.
  • Demonstrated successful experience building and operationalizing programs including developing policies and procedures.
  • Ability to work with cross-system partners to improve coordination of care for individuals with multiple needs.
