Estate Planning and Probate Associate
Position Overview
We are seeking an experienced Estate Planning and Probate Associate to join our firm. The successful candidate will prepare and administer estate and trust documents, manage probate and trust administration matters, advise clients on tax-efficient and protective estate strategies, and support contested matters when necessary. This role combines hands-on client counseling, detailed document drafting, court filings, and coordination with fiduciaries, financial advisors, and tax professionals to ensure compliant, efficient estate outcomes.
Key Responsibilities
- Draft and review estate planning documents, including wills, revocable and irrevocable trusts, durable powers of attorney, advance health care directives, and beneficiary designations.
- Manage trust and estate administration from opening through closing: inventory assets, prepare accountings, coordinate asset transfers, and distribute assets to beneficiaries in accordance with governing documents and applicable law.
- Prepare and file probate and estate-related pleadings, petitions, inventories, accountings, motions, and other court documents; appear in probate court as necessary.
- Advise clients on estate, trust and tax planning strategies including estate tax planning, asset protection, Medicaid planning, and business succession planning.
- Prepare and coordinate estate/trust tax filings, including Form 706 (Estate Tax) and Form 1041 (Fiduciary Income Tax) and work with CPAs on IRS compliance issues.
- Handle special needs planning, including drafting and administering Special Needs Trusts and coordinating benefits planning.
- Provide contested probate and litigation support: assist with litigation strategy, discovery, drafting pleadings, and working with outside counsel on contested fiduciary matters.
- Oversee and prepare trust accounting and enforce fiduciary duties; advise trustees and executors on their responsibilities and best practices.
- Prepare and execute title and deed transfers, coordinate closings, and manage associated filings and recording requirements.
- Use legal software and document automation tools (HotDocs, WealthCounsel, estate planning software) to produce organized client work product; manage electronic signature workflows with DocuSign.
- Serve as primary client contact for counseling sessions, intake interviews, and ongoing communication; coordinate with financial advisors, tax professionals, and other third parties.
- Maintain up-to-date knowledge of probate court procedures, guardianship/conservatorship processes, and notary and court filing requirements.
Qualifications
- Juris Doctor (JD) from an accredited law school and admission to WSBA.
- Minimum 3 years of substantive experience in estate planning, trust administration, and probate practice; greater experience or specialized skills preferred.
- Demonstrated knowledge of wills, trusts, trust administration, estate administration, probate court procedures, guardianship/conservatorship, powers of attorney, and advance health care directives.
- Experience preparing and coordinating estate/trust tax filings, including Form 706 and Form 1041, and working with tax professionals on IRS compliance.
- Familiarity with Medicaid planning, elder law matters, Special Needs Trusts, asset protection strategies, charitable planning (CRTs/CLTs), and business succession planning.
- Experience with contested probate matters and litigation support, including drafting pleadings and working with litigation counsel.
- Proficiency with document automation and practice management tools such as HotDocs, DocuSign, WealthCounsel, Clio, and other estate planning software.
- Strong drafting, legal research, and writing skills; attention to detail in document and pleading preparation.
- Practical experience with trust accounting, fiduciary duties, beneficiary designations, title and deed transfers, court filing procedures, and notary requirements.
- Excellent client counseling and communication skills; ability to manage multiple matters, meet deadlines, and work collaboratively with clients and colleagues.
- High ethical standards, professionalism, and commitment to client confidentiality; ability to pass background checks and, if required, obtain or maintain notary commission.
