Technical Advisor II ( Associate Counsel-Property Tax Policy & Litigation)

The Illinois Department of Revenue is seeking to hire attorneys in its Springfield Litigation and Property Tax Policy division. Under general direction, the attorney hired in this position will assist the Deputy General Counsel and other Department attorneys to draft and review legislation and administrative rules, advise agency staff and the public on interpretation of Illinois property tax laws, and formulate legal guidance on matters related to property tax. The incumbent will also represent the Department in tax litigation hearings and cases. This position is an excellent opportunity for an attorney with litigation experience who is also seeking experience interpreting and applying tax statutes and administrative rules in the field of property tax.

Essential Functions

  • Under general direction, performs technical and legal work in representing the Illinois Department of Revenue (IDOR) in routine income, sales, excise, and property tax litigation cases.
  • Researches and analyzes routine case appeals, court rulings and decisions, the tax statutes, regulations, field audits, investigative reports, documents of public record and other material submitted by taxpayers and IDOR auditors to prepare for hearings.
  • Confers with supervisor in resolving difficult or problem cases involving compliance or statutory interpretation and/or application to specific tax issues.
  • Confers and corresponds with taxpayers, their representatives, attorneys and other interested parties regarding the application or interpretation of Illinois taxes acts, rules and regulations.
  • Assists higher level staff in conducting income, sales, excise, and property tax litigation cases, hearings and general law duties relative to all taxes administered by IDOR.
  • Assists higher level litigators in advising IDOR managers and other personnel on matters pertaining to tax statutes, rules, regulations, IDOR policies and procedures to avoid conflict in the law and with regular access to information regarding pending decisions involving negotiations, proposed contracts or acquisitions, premature knowledge of which would limit future choices by the administration.
  • Performs other duties as required or assigned, which are reasonably within the scope of duties enumerated above.

Minimum Qualifications

  • Requires graduation from a recognized law school.
  • Requires possession of a valid license to practice law in Illinois.

Preferred Qualifications

  • Two (2) years of experience analyzing, appraising, and organizing facts, evidence and precedents and presenting such material, involving a moderately complex problem, in clear and logical form in writing as briefs, memoranda, summaries, research reports or regulations.
  • Two (2) years of experience litigating cases or controversies.
  • Two (2) years of experience developing policy, reviewing and drafting legislation or reviewing and promulgating regulations.
  • Two (2) years of experience working with judicial or quasi-judicial procedures, and rules of evidence.
  • Two (2) years of experience performing legal administrative and regulatory functions.
  • One (1) year of experience working with property tax exemptions, sales tax exemptions, or tax litigation.

Conditions of Employment

  • Requires the ability to successfully complete a tax compliance and fingerprint-based background check.
  • Requires ability to travel in the performance of duties, with overnight stays as appropriate.
  • Requires the ability to use and secure a state issued mobile device, e.g., cellular phone, laptop computer, tablet, etc.
