You must be currently reachable on the appropriate eligible list for this title or eligible to transfer to this title under Section 70.1 or 70.4 of the Civil Service Law.
Transfers:
For 70.1 or 70.4 transfer to a Legal Assistant 2, salary grade (SG)-17, you must have one year of permanent competitive, or 55-b/55-c service in an approved title for transfer allocated to an SG-15 or above.

Duties Description
Under the supervision of an attorney, summarize, track and draft correspondence in beneficiary designation, power of attorney, guardian, trusts, recovery, record requests, FOIL inquiries, hearing and litigation matters.
  • Help to maintain the database which tracks the workflow of cases by inputting information about incoming correspondence and how it was handled.
  • Examine incoming NYS power of attorneys, guardianship, trust and other legal documents to determine if they are valid, limited, or invalid for Retirement System purposes; draft memos and letters explaining the determination for each document and forward to the appropriate business unit for distribution.
  • Draft and send Chapter 7 Bankruptcy letters when initial proceeding notifications come in.
  • Handle incoming record requests by tracking correspondence and payment for request records; order folders or use FileNet to print copies of appropriate materials to send to the requesting party.
  • Draft response letters in miscellaneous cases at the request of staff Attorneys.
With general direction and supervision by an attorney, handle all aspects of the investigation and recovery of overpaid retirement benefits. This involves drafting subpoenas, reviewing subpoenad documents, analyzing cases and referring cases to OSC Investigations or outside prosecuting agencies when appropriate.
  • Review subpoenaed financial records to determine where retirement funds have been moved.
  • Analyze cases and prepare written memorandum summarizing the relevant facts and next steps for handling.
  • Refer cases to OSC Investigations Unit or the Office of the Attorney General for further investigation and processing.
  • Assist with the settlement of non-criminal recovery cases and obtain approval from Counsel for the Retirement System, NYSLRS Executive Management team, and other relevant parties.
  • Track the investigation/processing of all civil recovery matters that are referred to Legal Services for review.
Training and supervision of a Legal Assistant 1. Occasional clerical duties including, but not limited to, phone coverage, mailings, photocopying and/or scanning documents, tracking attorneys’ Continuing Legal Education (CLE) information, and alternate meeting attendance with other support staff.
  • Meet regularly with Legal Assistant 1 to coordinate assignments and review work.
  • Train Legal Assistant 1 on policies and procedures followed by the Division of Legal Services and Division of Retirement Services.
  • Provide phone coverage for other support staff when needed.
  • Collect, track, and maintain CLE credits earned by attorneys.
  • Attend meetings on various Retirement-related topics on an alternating basis with other Retirement support staff.

Telecommuting:
The Office of the New York State Comptroller (OSC) supports telecommuting where it is reasonable to do so based upon the agency’s mission and operational needs. Generally, employees new to OSC will be restricted from telecommuting for at least 8 calendar weeks. After the initial 8 calendar week restriction, if an employee’s duties and work performance are aligned with telecommuting they may be allowed to do so. Upon approval to telecommute, OSC employees may telecommute up to 5 days per pay period.
