Director of Compliance: This position is accountable to lead and administer the organization’s Quality Management Program, consistent with the organization’s mission and goals, the organization’s Strategic Plan, state licensure rules, accreditation standards and best practices.
This position oversees the Corporate Compliance Program, ensures management and employees are in compliance with the rules and regulations of regulatory agencies, that company policies and procedures are being followed and that behavior in the organization meets the company’s standards.
Duties include:
  • Provides leadership and support to adequately prepare for the organization’s accreditation and regulatory audits/reviews/reports/studies and site visits using measurable performance standards and outcomes. Ensures the organization’s licensed locations meet the AZ Department of Health Services (ADHS) and Medical Facility Licensing standards and requirements, also includes the Vaccines for Children program and CLIA lab monitoring.
  • Serves as the organization’s designated HIPAA and Compliance Officer. Actively represents JFCS at the Regional Behavioral Health Authority and other health plan meetings and all other meetings with contractors and stakeholders for Compliance communications and related issues.
  • Monitors and coordinates compliance activities with other departments providing status updates and trends.
  • Identifies potential areas of compliance vulnerability and risk; develops / implements corrective action plans for resolution of problematic issues, and provides general guidance on how to avoid or deal with similar situations in the future.
  • Completes Whistle Blower and Privacy Investigations as they relate to clients (such as improper release of PHI or conflict of interest). Ensures proper reporting of violations or potential violations to authorized enforcement agencies as appropriate and / or required, such as HIPAA breaches. Coordinates with Human Resources in all matters concerning employees or contractors.
  • Monitors and updates the master matrix of contract deliverables to Medicare / Medicaid
  • Provides oversight and documentation of all current and new JFCS policies & procedures.
  • Works in conjunction with the Training & Development Department to ensure HIPAA Compliance and Fraud, Waste and Abuse training is current for the agency as required by regulators and payers.
  • Works in conjunction with the Contracts Department to ensure compliance with all Business Associate Agreements.
  • Works in collaboration with the Business Intelligence and Information Technology Departments to ensure HIPAA, HITECH and other applicable healthcare security and safeguards are in place for electronic Protected Health Information (PHI).
  • Is able to review legal documents, such as subpoenas, custody papers, and court orders in order to provide to guidance to clinical staff on what client information is appropriate to release and the implications on patient care.
  • Consults and guides the company in the establishment of controls to mitigate risks.
Key Performance Indicators
  • Coordinates development and implementation of studies and instruments utilized for program monitoring, evaluation and improvement. Analyzes compliance and risk data and prepares user-friendly information/reports in a timely manner.
  • Prepares required reports including Compliance and Risk quarterly reports, Investigative reports, Presentation Materials, etc.
  • Develops and implements audit processes and has the ability to analyze, comprehend and respond to findings.
  • Successfully analyzes and resolves complex compliance issues.
  • Correctly monitors and reports agency’s deliverables to government and other contractual entities.
  • Maintains COA accreditation readiness agency-wide, and successfully prepares and maintains JFCS COA Standards.
  • Correctly makes data driven decisions and is able to act on facts.
  • Is able to reference sources and statutes and provide interpretation to the agency for being adherent to applicable regulations.
  • Ensures the agency has a current Corporate Compliance Plan and Emergency Response and Business Continuity Plan applicable to OIG, SAM, AZDHS, COA as well as other governmental and contractual entities.
Qualifications:
  • Master’s Degree in related field preferred. Bachelor’s degree and equitable experience in Healthcare Corporate Compliance may be substituted for Master’s Degree.
  • 5 years’ experience in Behavioral Health Corporate Compliance strongly preferred.
  • Demonstrated knowledge of State and Federal regulatory requirements
  • Comprehensive understanding of Medicare and Medicaid standards.
  • High standard of verbal and written communication.
