The Illinois Department of Revenue is seeking to hire attorneys to support its Litigation efforts. Reporting to the Deputy General Counsel for Sales/Excise Tax Litigation, the ideal candidate will have knowledge and experience in litigation, civil procedure, state and federal tax laws, and administrative and regulatory functions. This position is an excellent opportunity for an attorney who can excel managing his or her own caseload while advancing the Department’s objectives of fair and efficient tax administration.

Essential Functions

  1. Under administrative direction and with access to information regarding pending decisions, involving negotiations, settlement agreements or proposals, premature public knowledge of which would limit future choices by the administration, performs specialized legal and technical duties in the Chicago Sales, Excise and Property Tax Litigation Section.
  2. As an expert authority provides recommendations which must be considered in the development or modification of programs and services where there is considerable room for disagreement on the interpretation of comprehensive program goals and concepts for the preparation of legal memoranda including summarization of material evidence, facts and laws as necessary for administrative law judges to assist in determining how to render a decision.
  3. Confers and corresponds with taxpayers, their representatives, attorneys, and other interested parties regarding the application or interpretation of the Sales, Excise and Property Tax Acts, rules and regulations.
  4. Participates directly as an expert on whose advice IDOR managers, other personnel and key decision makers rely on in formulating administrative policies on matters pertaining to the Sales, Excise and Property Tax statutes, rules, regulations, IDOR policies and procedures to avoid conflict in the laws.
  5. Researches and analyzes case appeals, court rulings and decisions, the tax statute, regulations, field audits, investigation reports, documents of public record and other material submitted by taxpayers and IDOR auditors to prepare for litigation hearings.
  6. Conducts hearings, administrative conferences and performs general law duties relative to the various income & property taxes as necessitated by workload demands.
  7. Confers with supervisor to receive advice and guidance in resolving difficult or problem cases involving compliance or statutory interpretation and/or application to specific issues.
  8. Performs other duties as required or assigned which are reasonably within the scope of duties enumerated above.

Minimum Qualifications

  1. Requires graduation from a recognized law school.
  2. Requires the possession of a license to practice law in Illinois.
  3. Requires three years professional experience in the practice of law in the area of program specialization.

Preferred Qualifications

  1. Three (3) years of experience working with common law and state and federal laws, particularly relating to administrative and regulatory functions.
  2. Three (3) years of experience working with judicial and quasi-judicial procedure and of the rules of evidence, hearings, and trials procedures.
  3. One (1) year of experience working in the field of law with which primarily concerned, i.e., revenue tax law.
  4. Three (3) years of experience working with principles of administration and management, including organization, controls and techniques used in dealing with management and procedural problems.
  5. Three (3) years of experience planning, coordinating and reviewing work relating to complicated legal problems.
  6. Three (3) years of experience analyzing, appraising, and organizing facts, evidence and precedents concerned in difficult and complex cases and in presenting such material in clear and logical form for oral or written presentation, as briefs, orders, reports or decisions.

Conditions of Employment

  1. Requires the ability to successfully complete a tax compliance and fingerprint-based background check.
  2. Requires ability to travel in the performance of duties, with overnight stays as appropriate.
  3. Requires the ability to use and secure a state issued mobile device, e.g., cellular phone, laptop computer, tablet, etc.
