JOB DESCRIPTION
Characteristics of the Class: Under supervision of the Labor Compliance Administrator, the incumbent in this administrative position will ensure federal and state labor standards compliance on a variety of Housing Authority construction and maintenance projects where state and federal labor laws and regulations apply, including payment of state prevailing wages, HUD-approved maintenance wages and/or Davis-Bacon wages. 
  • Attend, and when necessary, conduct pre-bid and pre-construction meetings to ensure contractors, subcontractors and developers are aware of applicable labor laws and regulations.
  • In consultation with the Housing Authority’s Publics Works and Compliance Administrator and others as may be requested, review bid specifications and analyze project specifications and scopes of work to help ensure utilization of the appropriate wage determination(s) and incorporation of required regulatory provisions.
  • Assist in advising on labor compliance issues during preparation and evaluation of Invitation for Bids (“IFB”s) and Request for Proposals(“RFP”s).
  • Assist with monitoring, investigating, and reporting on the labor practices of contractors and subcontractors engaged in construction and maintenance activities on behalf of the Housing Authority to determine compliance with federal and state labor laws and regulations. These activities include visiting construction sites to interview workers and confirm legally required state and federal notices are posted.
  • Receive and document complaints of noncompliance; conduct meetings with complainants to obtain information and documents to determine validity of complaints; 
  • Communicate, clarify, and inform noncompliant contractors and subcontractors of labor laws and regulations, noncompliance issues, and assist with resolutions of potential noncompliance issues and/or complaints. 
  • Document all contacts with contractors and subcontractors regarding potential noncompliance for supervisor review.
  • Coordinate and perform audits of contractors and subcontractors engaged in construction and maintenance activities on behalf of the Housing Authority to ensure compliance with federal and state labor laws and regulations utilizing available staff and resources; secure and review certified payroll reports, other construction records, logs, observations and assist with conducting contractor staff interviews.
  • Assist with the preparation of periodic written reports to senior and middle management staff summarizing contractor and subcontractor audits and the progress of outstanding projects. 
  • Assist in preparation of administrative or technical reports, analyses, and summaries including the Semi-Annual Labor Standards Enforcement Report for HUD.
  • Assist in securing HUD approval of bi-annual HUD-approved Maintenance wages updates.
  • Assist with setup and maintain labor compliance projects files.
  • When necessary, represent the Housing Authority at labor compliance meetings with both internal and external parties.
Desired Knowledge, Abilities, and Skills:
Knowledge of:
  • Relevant state wage and labor laws and regulations governing the procurement and contracting process for construction and maintenance projects. 
  • Relevant Davis-Bacon and/or Davis-Bacon and Related Acts provisions that governing the procurement and contracting process for federally funded construction activities.
  • MS Word and Excel, database computer systems, including systems designed for tracking certified payroll activity including LCP Tracker.
Ability to:
  • Read and comprehend construction specifications and scopes of work for purposes of identifying applicable wage classifications. 
  • Interpret and apply federal and state labor laws and regulations.
  • Have an analytical and collaborative approach that facilitates compliance within the framework of federal and state laws and regulations,
  • Develop and make presentations related to labor compliance.
  • Communicate clearly in writing and orally, with senior and middle management staff, contractors, subcontractors, government representatives, and regulatory officials.
  • Use independent judgment and apply appropriate decision-making related to construction specifications and applicable labor standards.
  • Accurately assess construction trade practices to determine compliance with applicable labor standards.
