Position Summary:

The City Attorney’s Office performs all legal services for the City, including legal advice to City Officials, preparation and review of contracts and other legal documents, prosecution of persons accused of violating City ordinances, and representation of the City and City officials in lawsuits. The City Attorney’s Office does not provide legal advice to members of the public.

This position performs professional legal work at the direction of the City Attorney, including representing the City in legal proceedings, conducting the City's legal business, and performing related work as required.

Counseling & Advisory

· Provide legal advice to Mayor, Aldermen, City officials, and Department Heads regarding legal matters.

· Provide legal training to City staff as requested. Track and analyze new legislative and case law developments related to prosecution matters and make appropriate recommendations.

· Review and recommend changes to the municipal code as needed to improve clarity and to ensure compliance with applicable State and Federal laws, rules and regulations.

· Draft ordinances, resolutions, and other legal instruments as may be required by the City.

· Attend Common Council and other governmental meetings as needed.

Transactional

· Prepare and/or review and make recommendations on contracts on behalf of the City.

· Review and provide recommendations on insurance policies, and other documents affecting the City, including recommendations as to the validity and sufficiency of such documents.

· Review claims, licensing matters, and other basic municipal law matters at the direction of the City Attorney.

Litigation

· Prosecute ordinance violation cases, including but not limited to: traffic, housing, building, and fire code violations.

· Represent the city in court proceedings related to prosecution of city ordinance matters in municipal, circuit, and appellate courts, and otherwise assigned.

· Represent the City at administrative hearings held by state agencies, including but not limited to: Department of Transportation, Department of Industry, Labor and Human relations, and Department of Health and Social Services.

· Prosecute and defend actions involving the City of Sheboygan as assigned by the City Attorney.

Administrative

· Ensure the City Attorney is appropriately informed about legal issues as they arise.

Other

· Establish and maintain an effective working relationship with other employees, the general public, City officials, and officials of other governmental bodies.

· Assist in the performance of the duties and functions of the City Attorney.

· Write correspondence and perform general office work on matters pertaining to the City.

· Perform related work as assigned.

  • Admission to the bar in the State of Wisconsin or eligibility for admission.

· Basic knowledge of general legal principles and municipal law.

· Knowledge of municipal, circuit, and appellate court procedures and rules of evidence.

· Basic knowledge of administrative law, practice and procedure.

· Ability to understand and interpret constitutional provisions, statutes, administrative regulations, and legal precedents.

· Ability to analyze statutory and case law and provide legal advice based upon such analysis.

· Ability to draft legal documents and records.

· Ability to respond quickly to defendants and defense attorneys.

· Ability to perform legal research and draft well-written and clear letters, opinions, briefs and memoranda.

· Ability to work cooperatively and communicate effectively in written and verbal form.

· Ability to work independently and collaboratively as appropriate.

· Ability to appropriately maintain sensitive and confidential information.

· Ability to understand and interpret complex written materials.

· Ability to analyze, assess, and organize facts, evidence, and precedents and effectively present such materials verbally and in writing.

· Knowledge of MS Office and Outlook, and the ability to adapt and utilize multiple software programs.

· Ability to work with all demographics preferred.

· Ability to act, make decisions, and justify action based on logic, good judgment and rational thought.

· Possess a valid Wisconsin Motor Vehicle Operator’s license.
