JOB SUMMARY :

This position provides assistance to the Solicitor by preparing accusations for arraignment and for trial.

ESSENTIAL FUNCTIONS AND RESPONSIBILITIES :

Prepares accusations when the Solicitor General?s Officer receives warrants or citations from law enforcement agencies; reviews accusations for accuracy, completeness, and legality; determines if additional investigation is necessary.

Appears in court for probation revocations, bench trials, arraignments, traffic arraignments, bond hearings, drug court, alternative language court, and jury trials.

Prepares for jury trials; reviews cases to ensure all witnesses are subpoenaed; prepares plea recommendations; communicates with defendant’s attorneys regarding plea negotiations; researches case law regarding charges; prepares appropriate motions and jury charges.

Researches case law in preparation for motions; subpoenas witnesses, conducts motion hearings, and argues motions to the court.

Provides assistance to law enforcement regarding legal questions.

Meets with victims and their families to discuss sentencing recommendations.

Supervises the work of personnel.

Drafts appellate briefs and motions.

Regular and predictable attendance is required.

Performs other duties as required.

MINIMUM QUALIFICATIONS REQUIRED :

Education and Experience:

Juris Doctorate required

One year of experience as a practicing attorney with experience in three practice areas. Practice areas include: civil litigation, criminal litigation, administrative proceedings, appellate practice, contracts, real estate/probate, corporate, local government (ordinance, zoning, human resources, etc), environmental, and/or taxation.

Supervisory experience preferred.

Licenses and Certifications:

Must be a member of the Georgia Bar Association.

Knowledge, Skills, and Abilities:

Knowledge of state laws, court proceedings, rules of evidence, policies, procedures, and activities of the Solicitor’s office as they pertain to the performance of duties relating to the position of Associate Attorney.

Knowledge of alternative sentencing regulations and available sentencing facilities.

Knowledge of judiciary transcripts, police reports, crime lab reports, medical reports, intoximeter results, criminal history reports, and procedures and methods as required in the performance of duties.

Knowledge of word processing and database computer applications, utilizing word processing in the preparation of legal motions and briefs, and using database applications for performing research functions as required.

Knowledge to keep abreast of any changes in law, policies, regulations and methods as they relate to departmental operations and activities.

Knowledge of the terminology used within the department.

Knowledge of the Official Code of Georgia Annotated, state and federal case law, and the Uniform Rules of State Court.

Skill in computer applications, utilizing software in the preparation of legal documents and with software used in the research of laws and the interpretation of law, case histories, and other pertinent information.

Ability to compile, organize, prepare and maintain an assortment of records, reports and information in an effective manner and according to departmental and/or governmental regulations.

Ability to interpret and analyze legal information and prepare and present oral and written reports and legal documentation.

Ability to communicate effectively with supervisors, other staff members, and the public at large.

Ability to use independent judgment in routine and non-routine situations.

Ability mathematical handle required mathematical calculations.

Ability to utilize and understand computer applications and techniques as necessary in the completion of daily assignments.

Ability to plan, organize and/or prioritize daily assignments and work activities.

Ability to comprehend and apply regulations and procedures of the department.

Physical Ability: Essential functions of this position continuously require the ability to remain in a stationary position (sitting or standing); operate a computer and other office machinery, such as a calculator, copier, and printer. Incumbents must continuously be able to think analytically; handle stress and emotion, concentrate on tasks, remember names and other details; examine and observe details; make decisions, and adjust to change. Incumbents must also continuously direct others; meet deadlines; stay organized; use math/calculations and use a keyboard/type.

Essential Functions frequently require the ability to move about inside the office; and move/transport items up to 10lbs.

Essential functions occasionally require the ability to bend body downward and forward by bending spine and legs, and twisting at the waist, hips or knees; reach overhead; push or pull; and repetitively use hands/arms/legs. Incumbents in this position are occasionally required to be on-call and work irregular hours.

Sensory Requirements: Essential functions regularly require the ability to use effective verbal and written communication; and use of hand/eye coordination and fine manipulation to use equipment.

Environmental Factors: Essential functions of this position continuously require the ability to either work with others or work alone.
