In-House Counsel – Medical Malpractice & Risk Assessment Specialist
Location: Boston, Hybrid
We are seeking an experienced Attorney with deep expertise in medical malpractice and risk management to join our legal team supporting hospitals, physician groups, and healthcare systems. This role combines hands-on malpractice defense, proactive risk assessment for physicians, and sophisticated contract drafting and negotiation across a broad range of agreements.
Key Responsibilities:
Medical Malpractice & Physician Risk Management
• Evaluate potential malpractice claims and provide rapid risk assessments for attending physicians, residents, and hospital departments.
• Advise hospital risk management teams on liability exposure, documentation best practices, and incident response protocols.
• Collaborate with clinical leadership to develop physician-specific risk mitigation strategies and training programs.
• Assist in preparing for depositions, mediations, and trial in high-stakes malpractice cases.
Contract Drafting, Review & Negotiation
• Draft, review, and negotiate complex agreements, including:
• Professional liability insurance policies and reinsurance agreements
• Private equity investment agreements for physician practice acquisitions and joint ventures
• Hospital-physician employment and recruitment agreements
• Vendor contracts (e.g., EHR systems, staffing agencies, telehealth platforms)
• IT and data security agreements (HIPAA, HITECH, BAA compliance)
• Ensure contractual terms align with regulatory requirements (Stark, Anti-Kickback, CMS conditions of participation).
Strategic Advisory
• Identify and mitigate legal risks in physician-hospital relationships, including privilege delineation, peer review, and credentialing.
• Support M&A due diligence for healthcare transactions involving malpractice tail coverage and indemnification.
Qualifications:
• J.D. from an accredited law school and active license to practice law in at least one U.S. state (multi-state licensure a plus).
• 4 years of experience in medical malpractice defense
• Proven track record in healthcare contract negotiation, especially insurance/reinsurance and private equity deals.
• Strong working knowledge of healthcare regulations (HIPAA, Stark, AKS, False Claims Act).
• Exceptional analytical, drafting, and negotiation skills with meticulous attention to detail.
• Ability to distill complex legal and clinical issues into clear, actionable advice for non-lawyer stakeholders.
• Experience with hospital risk management or in-house counsel roles highly desirable.
Preferred Skills:
• Prior in-house experience at a hospital, health system, or medical professional liability insurer.
• Familiarity with claims-made vs. occurrence policies, tail coverage, and self-insured trusts.
Salary : $140,000 - $150,000
