Position Overview
We are seeking a skilled Estate Planning Attorney to advise individuals, families, and fiduciaries on comprehensive estate planning, tax-efficient wealth transfer, and elder law matters. The ideal candidate will draft and implement wills, trusts, powers of attorney, and advance directives; provide Medicaid and long-term care planning; assist with probate and trust administration; and collaborate with financial advisors to create integrated strategies that meet clients goals while minimizing tax exposure and preserving assets for future generations.
Key Responsibilities
- Counsel clients on estate planning goals and develop personalized strategies for wills, revocable and irrevocable trusts, powers of attorney, advance health care directives, and beneficiary designations.
- Draft, review, and execute estate planning documents, including complex trust agreements, marital deduction and credit shelter planning, and charitable giving instruments.
- Advise on federal and state gift, estate, and income tax implications; prepare and review estate tax returns and tax-related filings in coordination with tax professionals.
- Provide elder law and long-term care planning, including Medicaid planning, asset protection strategies, special needs planning, and guardianship/conservatorship matters.
- Assist with trust and probate administration: advise executors and trustees, prepare necessary pleadings, prepare accountings, and manage estate settlement processes.
- Represent clients in contested probate, trust disputes, guardianship hearings, and other estate litigation when necessary or coordinate with litigators.
- Conduct legal research and stay current on changes in estate, tax, and elder law; ensure compliance with state and federal regulations affecting estate planning and fiduciary duties.
- Maintain accurate client files, billing records, and engagement letters; work with paralegals and support staff to ensure timely delivery of services.
- Develop and maintain relationships with financial advisors, accountants, insurance professionals, and other referral sources to grow the practice.
- Participate in community outreach, client seminars, and continuing legal education to educate clients and referral sources on estate planning topics.
- Juris Doctor (JD) from an accredited law school and admission to the state bar in good standing.
- 3 years of experience practicing estate planning, wills, trusts, and probate; candidates with significant elder law or tax planning experience are encouraged to apply.
- Proven knowledge of federal and state estate, gift, and income tax principles and experience preparing estate tax returns or working alongside tax advisors.
- Experience with Medicaid planning, long-term care issues, and guardianship/ conservatorship proceedings preferred.
- Strong drafting skills with attention to detail and the ability to prepare complex trust and estate documents.
- Excellent client counseling, negotiation, and oral/written communication skills; comfortable explaining technical legal and tax concepts to non-lawyers.
- Experience managing trust and probate administration matters and familiarity with court procedures related to estates.
- Ability to work independently and collaboratively in a team environment; experience supervising or coordinating with paralegals and support staff.
- Proficiency with legal practice management software, document management systems, and standard office productivity tools.
- Commitment to professional development and participation in relevant bar sections or estate-planning associations (e.g., ABA, AICPA estate planning groups, state trusts and estates section).
