Brand Racial Justice Act Fellow
Job Summary:
The University of San Francisco School of Law is hiring a Brand Racial Justice Act Fellow post-bar for a one-year position to implement the California Racial Justice Act (RJA). The position will be based primarily in the Marin County Public Defender's Office with oversight by the Marin County Public Defender. The position will consist of: (1) direct representation of clients with colorable claims under the RJA, (2) case consultation with attorneys working on RJA claims, (3) evaluation of relevant data, (4) conducting RJA trainings, and (5) working with grassroots groups to facilitate participatory defense for people facing charges, families, and communities.
Under the RJA, individuals can challenge the charging process, pretrial, trial, and sentencing proceedings, either during the pendency of the case or post-conviction in one of two ways: (1) proving that racial bias impacted an individual case; or (2) bringing a broader challenge with empirical data showing that their convictions and sentences were meted out in a racially biased manner. With respect to the latter challenge, the petitioners do not need to show that the racial discrimination was deliberate or clearly operative in their case. The RJA overturns the standard established by the U.S. Supreme Court in McCleskey v. Kemp, which states that proven racial disparities in the death sentences are "an inevitable part of our criminal justice system" and requires proof of intentional racial discrimination to invalidate a death sentence. Under the RJA, it is possible to prevail upon a showing of disparate impact, without proving racial animus.
Full Job Description:
Job Responsibilities:
  • With oversight by attorneys in the Marin County Public Defender's Office and supervision by USF Racial Justice Clinic attorneys, handle a reasonable caseload of RJA clients.
  • Work with defense counsel and experts in the litigation of Racial Justice Act cases.
  • Collaborate with different stakeholders, including the DA offices, public defender offices, criminal defense lawyers, victims' rights groups, prison advocacy groups, and community organizations.
Job Requirements:
  • Juris Doctorate (JD) degree required.
  • Understanding and commitment to USF's mission, vision, and values and the mission of the Marin County Public Defender's Office.
  • Taken the California Bar and are awaiting results.
  • Deep commitment to working towards anti-racism and to improving the criminal justice system.
  • Demonstrated record of working with underserved and marginalized groups.
  • Excellent verbal, interpersonal, organization, creativity, and writing skills.
  • Experience working with clients, crime victims, attorneys, judges.
  • Experience with or commitment to developing a strong understanding of the California Racial Justice Act.
  • A strong record of cultural humility, empathy, and cross-cultural communication skills.
  • Ability to work efficiently and effectively under pressure.
  • Ability to work collaboratively with attorneys, law students, paralegals, social services providers and other stakeholders.
  • Experience with or ability to work with a diverse student body, faculty and staff.
  • Prior experience working with community-based organizations.
  • Prior experience in data analytics and statistics is helpful, but not required.
