U.S. Courts is Hiring an United States Magistrate Judge Near Washington, DC

Duties

The duties of the position are demanding and include:

  • in criminal matters, presiding over most preliminary proceedings, trials and disposition of misdemeanor cases, and various pretrial and evidentiary proceedings, upon referral or delegation from a district judge; and reviewing and determining government applications for surveillance and warrants; and
  • in civil matters, presiding over trials and other dispositions, upon consent of the litigants; overseeing pretrial discovery; preparing reports and recommendations; and conducting mediations.

United States citizenship is required for consideration for this position.
Employees are required to adhere to the Code of Conduct for United States Judges.
Employees are required to use the Electronic Funds Transfer (EFT) for payroll deposit.
Final candidates will undergo a background investigation.
Selection will be made consistent with the provisions of the Equal Employment Opportunity Plan adopted by the United States District and Bankruptcy Courts for the District of Columbia.

Qualifications

The basic authority of a United States Magistrate Judge is specified in 28 U.S.C. § 636, and further specified under the Local Rules of this Court, see LCvRs 72.1-73.1; LCrRs 32.1, 57.17, 58 and 59.1-59.3.
To be qualified for appointment, an applicant must:
  • be, and have been for at least five years, a member in good standing of the bar of the highest court of a State, the District of Columbia, the Commonwealth of Puerto Rico, the Territory of Guam, the Commonwealth of the Northern Mariana Islands, or the United States Virgin Islands;
  • have been engaged in the active practice of law for at least five years. The court may consider, as substitute experience for the active practice of law, experience as a state judicial officer; a federal magistrate judge, bankruptcy judge or other federal judicial officer; an attorney for a federal or state agency; a law clerk, staff attorney or pro se law clerk (maximum two years); and other substantial legal experience;
  • be competent to perform all the duties of the office, of good moral character, emotionally stable and mature, committed to equal justice under the law, in good health, patient, courteous, and capable of deliberation and decisiveness;
  • not be 70 years of age or older, for an initial appointment; and
  • not be related to a Judge of the U.S. District Court for the District of Columbia within the degree of first cousin.

    Next steps

    A Merit Selection Panel composed of attorneys and other members of the community will review all applications, conduct interviews and reference checks as determined by the Panel, and recommend to the district judges in confidence the five applicants whom the Panel considers best qualified. The Court will make the appointment following an FBI full-field investigation and an IRS tax check of the applicant selected by the Court for appointment. The individual selected must comply with the financial disclosure requirements of the Ethics in Government Act of 1978, Pub. L. No. 95-521, 90 Stat. 1824 (codified at 5 U.S.C. app. 4 §§ 101-111), as implemented by the Judicial Conference of the United States.

    The current annual salary of the position is $223,836 per annum. The term of office is eight years.
