U.S. Army Cyber Command is Hiring a Supervisory Attorney Advisor (Contracts) Near Fort Meade, MD

Duties

  • Leads the team in providing authoritative information and recommendations to USCYBERCOM elements regarding all phases of the acquisition process.
  • Manages the team’s workload to assure legal representation is provided on acquisition strategy panels and to advise team members throughout the pre-solicitation phase of the acquisition process.
  • Reviews solicitations and amendments thereto for completeness and conformity to acquisition law, regulation, policy, and the appropriate acquisition strategy.
  • Reviews and drafts special provisions and unique clauses during the solicitation and award phases of the acquisition.
  • Leads the team in providing legal support for command and externally directed official audits, and formal and informal Anti deficiency Act investigations and reports.
  • Leads the team in providing litigation support to defend USCYBERCOM acquisition actions against protests and Contract Disputes Act appeals.
  • Develops, coordinates, and reviews memoranda of law and litigation reports sent forward to become the basis for the position asserted by the United States.
  • Works directly with the trial attorney in trial preparation to ensure that USCYBERCOM's interests are fully represented.
  • Directs and coordinates the work of assigned personnel. Assigns work to team members based on priorities, the difficulty of the work to be performed, and the capabilities of employees.
  • Evaluates work performance on a longer-term basis, assuring equity of developed performance standards and rating techniques.
  • Gives advice, counsel, or instruction to team members on both work and administrative matters. Identifies team members’ developmental and training needs and arranges for needed development and/or training.
  • Leads efforts to protect the Government's Intellectual Property rights in all federal acquisition actions conducted at USCYBERCOM, and address externally initiated requests for sensitive information regarding cyberspace programs and activities.
  • Identifies the need for and initiates actions to ensure protection of the Government's Intellectual Property rights in technical data and software for all acquisition actions conducted at USCYBERCOM and Federal Technology transfer initiatives.
  • Prepares specific clauses and contract language for insertion in USCYBERCOM contracts to ensure Government's Intellectual Property rights are protected.
  • Responsible for the provision of comprehensive advice and support to Freedom of Information Act (FOIA) managers and Offices of Primary Responsibility on proposed FOIA denials regarding contract issues consistent with applicable law and FOIA.
  • Leads the team’s review of and provides the Command’s and Government's position regarding Congressional and Presidential Inquiries and provides legal assistance in justifying such positions, as required.
  • Engages the Command’s leadership team and personnel to minimize the risk of potential ethics violations.

  • Appointment may be subject to a suitability or fitness determination, as determined by a completed background investigation.
  • A two-year trial/probationary period may be required.
  • This position requires the incumbent be able to obtain and maintain a determination of eligibility for a Top Secret Sensitive Compartmented Information (SCI) security clearance for access for the duration of employment.
  • This position requires the incumbent must complete a counterintelligence scope polygraph exam.
  • Employee must meet NSA personnel security requirements outlined in NSA/CSS Policy 5-1.
  • This position may require the incumbent to submit a Confidential Financial Disclosure Report (OGE Form 450) upon entry, and annually thereafter in accordance with DoD Directive 5500-7-R.
  • This position requires the incumbent to maintain active bar membership, in good standing (as defined by the pertinent bar) of the bar of the highest court of a State, U.S. territory, the District of Columbia, or Commonwealth of Puerto Rico.
  • This position is a testing designated position (TDP) in accordance with (IAW) Drug Free Federal Workplace Program.
  • Position requires participation in random drug testing in accordance with AR 600-85 and must pass drug-test prior to appointment and agree to submit urinalysis testing on a recurring basis.
  • Incumbent is required to sign a DA Form 5019-Condition of Employment for Certain Civilian Positions Identified Critical under the Department of the Army Drug-Free Federal Workplace Program.
  • Incumbent may be recalled to duty, may be required to work other than normal duty hours, which may include evenings, weekends, and/or holidays, and may be required to work overtime.
  • Incumbent may be required to support 24/7 legal activities in operations centers during contingencies and exercises.
  • Work may occasionally require travel away from the normal duty station on military and/or commercial aircraft.
  • Required to disclose pending ethics, judicial or miscellaneous allegations under review, including adverse findings by a state bar or disciplinary committee, must consent to provide a letter for each state were admitted demonstrating good standing.

Qualifications

Who May Apply: US Citizens
Applicants will be evaluated to determine if they meet the minimum qualification requirements and on the extent to which their application shows possession of the following knowledge, skills and abilities (KSAs) associated with the position.
KSA's:
  • Skill in identifying and researching highly technical and complex legal issues.
  • Skill in providing legal, technical, and policy guidance.
  • Ability to effectively, professionally, and ethically manage a heavy caseload of clients with complex legal needs.
  • Ability to supervise or lead others.
Qualification Requirements: The following minimum qualification requirements must be met before applicants are eligible for further consideration:
Education Requirements: Position requires the possession of the first professional law degree (LL.B. or J.D.) AND a member in good standing with the highest court of a State, U.S. commonwealth, U.S. territory, or the District of Columbia. Applicants for initial appointment into attorney positions within the Department of Army must be graduates of law schools accredited by the American Bar Association at the time of the applicant's graduation. As indicated below, a law school transcript must be submitted with your application materials.
Bar Membership: Applicants must currently be a member in good standing (as defined by the pertinent bar) of the bar of the highest court of a State, U.S. territory, the District of Columbia, or Commonwealth of Puerto Rico. As noted below, proof of such membership and good standing must be submitted with your application materials.
Experience: In addition to the requirements above, applicants for the GG-15 or equivalent Attorney positions must also possess 3 years of professional legal experience, acquired after being admitted to the bar, commensurate with the duties and responsibilities of the position. Graduation from an ABA-Accredited Law School in the top 25% of the class or an advanced law degree such as an LLM may substitute for one year of the required professional legal experience.
Time in Grade: The Qualifying Authorities (QA's) will make a determination as to the applicability of time in grade based on the requirements of the position. If you are currently employed as an attorney by the Federal government you must have completed one year at the next lower grade level within 30 days of the closing date of the announcement, or previously served at the same or higher grade level as the position being filled.
NOTICE OF VETERAN'S PREFERENCE: There is no formal rating system for applying veteran's preference to attorney appointments in the excepted service; however, the Department of the Defense considers veterans' preference eligibility a positive factor for attorney hiring. Applicants eligible for veterans' preference must include that information in their cover letter or resume and attach supporting documentation (e.g., DD Form 214, "Certificate of Release or Discharge from Active Duty") to their submissions.
Although the point-preference system is not used, applicants eligible to claim a 10-point preference must submit a Standard Form (SF) 15, "Application for 10-Point Veteran Preference", and supporting documentation required for the specific type of preference claimed. The SF 15 will identify the supporting documentation required along with the list of the types of 10-point preference.
