The pay range for this position is $36.49 - $50.07 per hour

The State of New Hampshire, Department of Safety, Office of the Commissioner, has a part-time vacancy for Hearings Examiner/Prosecutor, SOC Title 23-1020 ADMIN LAW JUDGES-6. This position is part time, which cannot exceed 29.5 hours per work week and does not offer insurance benefits.

SUMMARY: Provides prosecution assistance to the Division of State Police, Division of Motor Vehicles, State Fire Marshal, Marine Patrol, and State Office Complex Police Force as a member of the Prosecution Unit within the Bureau of Hearings.

18 Months or 1.5 Years of additional relevant experience = Associate's degree

36 Months or 3 Years of additional relevant experience = Bachelor's degree

54 Months or 4.5 Years of additional relevant experience = Master's degree

MINIMUM QUALIFICATIONS:

Education: J.D. from a recognized law school.

Experience: Five years' experience as an attorney, two years of which must have been as an attorney involved with administrative law or concerned with regulatory authorities.

License/Certification: Must possess a valid driver’s license for statewide travel.

SPECIAL REQUIREMENTS:

1. Must be an active member of the New Hampshire Bar Association and in Good Standing.

2. Selected candidate will undergo a fingerprint-based criminal background check and motor vehicle record check in order to ensure suitability for exposure to confidential information.

RESPONSIBILITIES:

Reviews arrest reports on court cases brought by State Police and other Department of Safety law enforcement personnel and makes decisions as to whether or not a case is prosecutable.

Holds pretrial conferences with defense attorneys regarding stipulations and negotiated pleas and attends pre-trial hearings. Responds to defense motions and prepares motions to continue and other motions on behalf of the State.

Coordinates representation on appeals to Superior Courts with the respective County Attorneys. Represents the State at pre-trial suppression hearings and other preliminary hearings.

Subpoenas witnesses and prepares and prosecutes cases before the Circuit Courts for misdemeanor cases statewide.

Researches case law and provides advice to superiors and to law enforcement personnel regarding cases in which the law enforcement personnel themselves may be functioning as prosecutors.

Evaluates court decisions to determine impact on the Department's law enforcement efforts and prepares educational materials regarding such decisions to assist law enforcement personnel with arrest-related procedures.

Explains complex policies, rules, and statutes to inquiring parties including law enforcement agencies, attorneys and members of the public in order to educate on best practices and to answer questions.

Conducts legal training on behalf of the Department at NH Police Standards and Training, at local police departments and at NH Bar Association attorney training programs in order to educate and provide information on best practices in prosecution.

Collaborates with the Bureau’s Chief Paralegal to supervise the assigned paralegal’s work products. Monitors the paralegal’s performance to ensure consistency with established guidelines. Works with the Chief Paralegal to complete annual evaluations and to develop and implement corrective action plans, if needed.
