Job Description

Real Estate Litigation and Commercial Transactions Attorney

Small, close-knit firm near downtown Ft. Lauderdale is seeking an attorney with 3 to 5 years of experience who primarily handles Real Estate Litigation and Commercial Litigation, but is preferably a hybrid attorney who also handles Commercial transactions and Real Estate transactions. This position is in the office – not remote. Portable book of business is a plus.

Regarding the Litigation part for this position:

  • Real Estate Litigation includes Landlord/Tenant disputes such as breach of lease, breach of contract, eviction, ejectment, partition, etc.. The attorney must know Florida’s landlord/tenant statutes (including notice requirements, deposit requirements, etc.) “inside and out.”
  • Commercial Litigation generally includes business disputes with companies, and involves a variety of different causes of action such as breach of contract, unjust enrichment, fraudulent and negligent misrepresentation, open account, account stated, fraud in the inducement, breach of fiduciary duty, business torts, FDUTPA, civil theft, etc.

Must be able to handle all stages of litigation from inception to trial, and everything in between, including all discovery, depositions, hearings (UMC and special set), mediations, etc., without supervision.

Must be able to create and implement a legal strategy to get target results (not just litigate for the sake of litigating) and communicate with clients and make them happy.

Trial experience, both bench and jury trial experience, is highly preferred.

Must be comfortable doing legal research on Westlaw.

Regarding the Transactional part for this position:

  • Commercial Transactions includes drafting Operating Agreements, Shareholder Agreements, By-Laws, Board Consents, Minutes, Partnership Agreements, Joint-Venture Agreements, Franchise Agreements, Purchase and Sell Agreements, Distribution Agreements, License Agreements, Loan Agreements, NDAs, etc. Experience with Wealth Counsel is preferable, but not required.
  • Real Estate Transactions includes negotiating and drafting both commercial and residential leases, and any other related real estate contracts.

About the Firm:

The firm is small, close-knit firm with 4 attorneys near downtown, Ft. Lauderdale that is a “one-stop shop" for small businesses, and its primarily areas of practice are: (1) General Counsel to small businesses, (2) Commercial and Real Estate Litigation, (3) Commercial and Real Estate transactions, (4) Trademarks, and (5) Estate Planning.

The firm truly embraces a work-life balance. Hours are 9 to 5, and the firm sometimes closes the office a little early on Fridays. In addition to giving 2 weeks PTO, the firm also closes the office the last week in December, but still pays everyone, which is like giving an extra one-week free vacation because, normally, most people take off the last week at the end of the year anyway. As such, the firm gives 3 weeks PTO.

The firm also offers health, vision, and dental insurance.
