The IP Legal Assistant’s role is to assist with all matters relating to the coordination and maintenance of the Trademark portfolio. This position supports the Associate Director, Intellectual Property, and local IP Department in daily activities managing the Company’s trademarks, IP review of advertising/marketing/promotional materials and other business materials, trade dress, oppositions, and litigation. The operations of the Intellectual Property Department require discretion and confidentiality.

The scope of the role will include U.S. and Canadian (with limited global) trademark portfolio management, advertising/marketing trademark and trade dress reviews, and trademark related opposition and litigation support.

Responsibilities broadly relate to procurement, maintenance, and proper usage of the Company’s U.S. and Canadian Trademark portfolio.

This position will work with and support the Associate Director of Intellectual Property and external legal counsel to:

  • Prepare and submit document, forms, and office action responses to the USPTO and Canadian Intellectual Property Office.
  • Coordinate with overseas trademark team to conduct preliminary availability searches and, in some instances, conduct and review searches independently utilizing internet‐based resources.
  • Coordinate with internal clients to prosecute, maintain, and renew trademark applications and registrations, including obtaining of samples and other documents for securing trademark registration
  • Monitor corporate trademarks by conducting weekly reviews of the Trademark Official Gazette and preliminary investigations of potential conflicting marks.
  • Review advertising, marketing, corporate materials, labelling and packaging for OTC, Brand Marketing and Generic Medicines groups to provide trademark clearance and ensure proper usage of trademarks, package inserts, including scripts for proposed videos, websites, etc.
  • This person will also be required to assist in other IP related projects as needed, including but not limited to providing litigation support, patent prosecution support, and assisting in budget preparation.

Qualifications:

  • Basic knowledge of trademark usage and experience working with trademark related prosecution to assist with the preparation and filing of legal forms, maintaining relevant databases/files, and facilitating legal work and office procedures
  • Knowledge of U.S. trademark legal regulations and procedures, required. Knowledge of International trademark legal regulations and procedures, preferred but not required
  • Understanding of USPTO trademark application and registration process, statement of use procedures, and renewal requirements
  • Experience in clearing trademarks/trade dress, preparing/filing/prosecuting trademark applications Required Technical Competencies
  • Knowledge and proficiency in Microsoft applications, including Word, Excel, Outlook, and PowerPoint
  • Experience with U.S. and international trademark databases required
  • Experience with trademark docketing or docket management software (e.g. CPI) required
  • Knowledge of USPTO databases (e.g., TSDR, TESS, TTAB)
  • Strong project management skills Required Behavioral Competencies
