Office of the Attorney General of Texas is Hiring a Remote OAG - Medicaid Fraud Control Unit -Assistant Attorney General IV-V- 23-1029

GENERAL DESCRIPTION

Applicants for this position should be prepared to pass a background investigation. Applicants will also be subject to a motor vehicle registration check and social media check. Since most security clearance problems arise from criminal records or unresolved bad credit issues, full criminal and credit checks will be run on all applicants prior to employment.

The office location for this position will be in the MFCU Field Office in Dallas. Because this position represents the MFCU and assists district attorney offices to prosecute criminal cases across the state, some travel will be required that includes overnight lodging. It is anticipated that the primary caseload will be in Harris County and surrounding counties but could include any county in Texas. Some travel to MFCU Field Offices in San Antonio, Tyler, Lubbock, Houston, Corpus Christi, El Paso, and Pharr may be required. Criminal prosecution experience and ability to perform as lead counsel for the state, including grand jury appearance and plea negotiation experience will be factors in selection for this position.

This position performs complex attorney work. Work involves assisting with health care fraud investigations as well as crimes against residents of long term healthcare facilities; preparing and prosecuting jury trials in state court; interpreting laws and regulations; providing legal advice, counsel, and assistance to state prosecutors; representing the State’s interest in criminal matters involving Medicaid; reviewing, evaluating, and rendering legal opinions. The position will be supervised by a senior MFCU attorney in the Austin headquarters.

ESSENTIAL POSITION FUNCTIONS

  • Prepares and presents complex criminal cases involving federal and state Medicaid laws and regulations, pursuant to the Texas Penal Code.
  • Prepares legal opinions, briefs, pleadings, motions, petitions, and other legal documents
  • Prepares all phases of criminal prosecution from investigation, including the preparation of cases for trial, jury and court trial, and appellate process when necessary
  • Analyzes complex factual and legal issues and develops evidence through witness interviews, depositions, and other discovery
  • Performs legal research and investigations, and reports findings and conclusions
  • Advises clients and management on factual and legal issues
  • Assists investigators and auditors in investigations
  • May train less experienced staff
  • Provides excellent customer service
  • Uses personal vehicle for business-related travel with reimbursement
  • Maintains relevant knowledge necessary to perform essential job functions
  • Attends work regularly in compliance with agreed-upon work schedule and in accordance with agency leave policy
  • Ensures security and confidentiality of sensitive and/or protected information
  • Complies with all agency policies and procedures, including those pertaining to ethics and integrity
  • Performs related work as assigned

MINIMUM QUALIFICATIONS

Assistant Attorney General (AAG) IV:

  • Education: Graduation from an accredited law school with a J.D.
  • Licensed as an attorney by the State of Texas
  • Member in good standing with the State Bar of Texas
  • Experience: Three years of full-time experience as a licensed attorney
  • Knowledge of laws and legal principles and practices relevant to the Medicaid Fraud Control Unit such as the Texas Penal Code, Code of Criminal Procedure, Texas Health and Safety Code.
  • Skill in handling multiple tasks, prioritizing, and meeting deadlines
  • Skill in effective oral and written communication [Writing sample required at time of interview, if selected]
  • Skill in exercising sound judgment and effective decision making
  • Skill in legal research, writing, and analysis; in conducting investigations; in mediation and negotiations; in using reasoning and logic; in identifying and solving complex problems; in prioritizing workloads; in using judgment to identify courses of action; and in the use of a computer and applicable software
  • Ability to prepare legal documents, to conduct research, to interpret and apply laws, to summarize findings, to prepare cases and present at trial, to conduct hearings, to communicate effectively, and to train others
  • Ability to receive and respond positively to constructive feedback
  • Ability to work cooperatively with others in a professional office environment
  • Ability to provide excellent customer service
  • Ability to work in person at assigned OAG work location, perform all assigned tasks at designated OAG workspace within OAG work location, and perform in-person work with coworkers (e.g., collaborating, training, mentoring) for the entirety of every work week (unless on approved leave)
  • Ability to arrange for personal transportation for business-related travel
  • Ability to work more than 40 hours as needed and in compliance with the FLSA
  • Ability to lift and relocate 30 lbs.
  • Ability to travel (including overnight travel) up to 40%

Assistant Attorney General (AAG) V: All the above qualifications for an AAG IV, PLUS:

  • Experience: One additional year full-time experience as a licensed attorney

PREFERRED QUALIFICATIONS

  • Experience in white collar crime, health care contracts, or business or finance law
  • Two years prosecution experience in federal or state court
  • Two years active trial experience
  • Board certified in criminal or administrative law
