GENERAL DESCRIPTION
The Office of the Attorney General (OAG) is a dynamic state agency with over 4000 employees throughout the State of Texas. As the State’s law firm, the OAG provides exemplary legal representation in diverse areas of law. Assistant Attorneys General experience the challenge and honor of public service while enjoying a healthy work-life balance; hands-on legal experience; and engaging camaraderie in Austin, the scenic and lively capital of Texas. This Assistant Attorney General (AAG) position is assigned to the Civil Medicaid Fraud (CMF) Division which investigates allegations of unlawful acts against the Medicaid program and prosecutes meritorious, civil enforcement actions brought under the Texas Medicaid Fraud Prevention Act and recovers taxpayer dollars. Most of the cases derive from private whistle-blower lawsuits filed under seal in which the state is allowed to intervene. These efforts aim to achieve deterrence of illegal conduct and reimbursement of ill-gotten gains to the State. The litigation is complex, and the work is meaningful. For this position, the OAG seeks a qualified, self-motivated candidate who desires to work as a member of a litigation team to litigate complex cases from inception to conclusion, including conducting all aspects of pre-trial litigation, discovery, preparing cases for jury trials, appearing at hearings, and trying cases as part of a litigation team. ESSENTIAL JOB FUNCTIONS
Assists in defensive discovery coordination for Civil Medicaid Fraud Division, working with a team of attorneys; works with client agencies to obtain, review, and produce documentation, data, and information responsive to defensive discovery requests; performs legal research and reports findings and conclusions
Analyzes factual and legal issues and develops evidence for filing of civil Medicaid fraud cases; reviews documentation from client agencies and other resources
Prepares legal briefs, pleadings, and other legal documents; drafts defensive and offensive discovery responses; conducts depositions
Represents the Office of the Attorney General before state or federal district and appellate courts
Performs related work as assigned
Maintains relevant knowledge necessary to perform essential job functions
Attends work regularly in compliance with agreed-upon work schedule
Ensures security and confidentiality of sensitive and/or protected information
Complies with all agency policies and procedures, including those pertaining to ethics and integrity

MINIMUM QUALIFICATIONS
Education: Graduated from an accredited law school
Licensed to practice law in Texas
Member in good standing with the State Bar of Texas
Experience: Four years of full-time experience as a licensed attorney.
Knowledge of law and legal principles and practices relevant to Civil Medicaid Fraud
Skill in working under pressure and cooperatively with other attorneys, supervisors, investigators and support staff
Skill in handling multiple tasks, prioritizing, and meeting deadlines
Skill in effective oral and written communication
Skill in exercising sound judgment and effective decision making
Ability to receive and respond positively to constructive feedback
Ability to work cooperatively with others in a professional office environment
Ability to provide excellent customer service
Ability to work in person at assigned OAG work location, perform all assigned tasks at designated OAG work space within OAG work location, and perform in-person work with coworkers (e.g., collaborating, training, mentoring) for the entirety of every work week (unless on approved leave)
Ability to telework due to pandemics, exposure to contagious conditions, weather, and health conditions where one can still work (must ensue the availability of secure internet connections at a designated telework site)
Ability to arrange for personal transportation for business-related travel
Ability to work more than 40 hours as needed and in compliance with the FLSA
Ability to lift and relocate 30 lbs.
Ability to travel (including overnight travel) up to 20%

PREFERRED QUALIFICATIONS
Experience: Working on complex civil litigation
Experience: Summation or Concordance legal review software
Knowledge: of law, legal principles, and practices relevant to the civil Medicaid fraud statues
Knowledge: of Texas Rules of Civil procedure, Texas Rules of Evidence, Federal Rules of Procedure, and Federal Rules of Evidence
Familiarity with Texas case law regarding discovery
