Minimum Qualifications:

law degree from an accredited law school; admission to, and member in good standing of, the New York State Bar; and two years of relevant post-bar experience.

Background in prosecution or affirmative litigation highly preferred.

Experience or demonstrated interest in investigating white collar crime, healthcare fraud, violations of complex regulatory regimes, or similar records-based matters.

Significant interview and/or deposition experience.

Experience developing investigation plans and directing and/or collaborating with investigators, analysts, and other members of an investigative team.

Superior legal research skills. Demonstrated experience identifying applicable statutes, regulations, and legal principles across various bodies of law.

Working familiarity with New York State laws and agencies relevant to public health, public safety, healthcare, licensed professionals, law enforcement, and regulatory oversight.

Strong written and oral communication skills. Experience drafting investigative reports and effectively conveying complex and voluminous information to various audiences and in various contexts.

Demonstrated experience drafting and/or litigating subpoenas and service of process highly preferred.

Superior interpersonal skills with a proven history of building and managing collaborative intra- and inter-agency relationships.

Duties Description:

In collaboration with Bureau of Investigations’ Investigative Specialists and Investigative Auditor, developing investigation plans; drafting subpoenas, requests for information (“RFIs”), preservation letters, “cease and desist” letters, PHL Section 16 orders, and other legal process; conducting legal research, including research on questions of first impression involving investigations under and enforcement of the Public Health Law; analyzing facts according to various bodies of law and categories of enforcement—including criminal, administrative, and civil—and making recommendations regarding potential enforcement actions; ensuring that all legal and evidentiary requirements, as applicable, are met; advising investigative teams on legal questions relevant to their investigatory work (e.g., search and seizure, 5th Amendment, etc.); managing applicable discovery obligations; coordinating and conducting formal investigative interviews; writing investigation reports and referral memos; communicating and coordinating with counsel for represented witnesses and subjects; communicating and coordinating with federal, state, and local prosecutors and with administrative hearing officers to whom Bureau of Investigations cases have been referred for prosecution/enforcement action. As necessary, either directly or through the Division of Legal Affairs Bureau of Litigation and/or the NYS Office of Attorney General, litigating motions to quash and motions to compel administrative subpoenas issued by the Bureau of Investigations. Pro-actively collaborating and liaising with other regulatory oversight and law enforcement agencies focused on public health and health care within New York State; attending collaboration meetings, symposiums, and conferences; giving presentations and trainings regarding Bureau of Investigations casework and the Department’s enforcement priorities; initiating, building, and maintaining strong working relationships with sister regulatory-enforcement agencies, law enforcement, and prosecutors’ offices. In collaboration with other staff within the Bureau of Investigations, the Division of Legal Affairs, and the Department, developing and coordinating general (i.e., not case specific) enforcement strategies and campaigns that address fraud, abuse, and misuse of Department programs and/or high-priority violations of PHL; identifying enforcement work being done by the Department and/or provided for by the PHL where the Bureau of Investigations can provide expert investigatory assistance and add value.
