Qualifications


Position Summary:

The Manager - Construction Contracts and Claims will assist the Projects department to ensure Midrex fulfills the requirements of several large-scale, international DRI plant projects. In addition to fulfilling our requirements, they will manage and resolve change order and claims process in accordance with contractual requirements and entitlements. The Manager - Construction Contracts and Claims will accurately interpret contract terms and conditions and technical specifications to identify and understand the risks, rights and responsibilities of the project teams and guide project teams in properly managing in accordance with these documents to limit Company’s exposure to additional costs. This role will be cross-functional, working with projects, procurement, finance, and legal departments.

The role requires proven ability to calculate cost and cash flow impact of claims, commercial sensibility, excellent communication skills, good understanding of contract terms and contract management and proficiency in reading and interpreting technical specifications and standards.

Duties/Responsibilities:

  • Interpret contract language to understand the risks, rights and responsibilities of the project teams and guide project teams in properly managing in accordance with these clauses to limit Company's exposure to additional costs.
  • While working with Project Management, Project Controls and Legal departments, The Contract & Claims Manager will supervise and coordinate the contract change order and claims management process, including the timely identification, documentation, notice, preparation, negotiation and closure of change orders and claims.
  • Attend meetings and represent Midrex regarding contract related matters.
  • Prepare extension of time, cost claims and change orders in accordance with contractual requirements including time and notice.
  • Work with project teams to pro-actively manage risk and opportunities related to actual and potential claims.
  • Work with project team and other departments to gather data to identify grounds for defense and counter claims.
  • Review and assess claims and prepares formal written responses to minimize risk and dispute.
  • Ensure project team compliance with contract requirements for routine notices and correspondence.
  • Assist project teams by developing and maintaining a contract notice and deliverables list to ensure all requirements are fulfilled.
  • Coordinate with Procurement management to ensure proper flow down of relevant Contract provisions.
  • Train and provide guidance to project teams for the purposes of limiting exposure or protecting the Company from additional risks due to change order requests.
  • Participate with the Project Manager and other project team members in change order negotiations.
  • Prepare strategic plan for resolving non-approved changes in accordance with internal processes and procedures.
  • Support project controls team to track, monitor and control costs or schedule and claim resolution.
  • Update internal databases as required.
  • Participate in and organize internal meetings and meetings with external contract partners.
  • Prepare and deliver progress reports on claims to senior management.
  • Assists legal team in preparing for disputes resolution meetings and potential hearings.

Skills/Abilities:

Required:

  • Prior experience with contract change orders, claims, dispute resolution and legal interface.
  • Experience with complex scheduling and cost control processes including knowledge of various methodologies for cash flow analysis and claim pricing.
  • Proven experience with EPS contract agreements and consortium partnerships.
  • Polished, professional demeanor with ability to communicate and present complex issues internally and externally to management, clients, vendors and other third parties.
  • Ability to develop relationships with Company partners and within the Company.

Preferred:

  • Experience in large-scale construction projects.
  • Experience with international projects.

Education and Experience:

  • Bachelor's degree in Business Administration, Engineering or Law required; MS/MBA preferred.
  • Minimum 8 years' experience in construction engineering, project management or project controls required

Travel Requirements:

  • Up to 10% internationally or domestically.

Physical Requirements:

  • Prolonged periods of sitting at a desk and working on a computer.
