Herzog is Hiring a Contracts Specialist Near San Jose, CA

Overview

TransitAmerica Services, Inc. is currently seeking a determined Contracts Specialist in San Jose, CA to join our team.

The pay range for this position is $85,500.00 - $95,000.00.

Duties and Responsibilities:

*This is a non-exhaustive overview of the job duties for this position.

  • Secure and analyze proposals, negotiates prices and terms with contractors, and recommends contractors with respect to cost, quality and delivery competitiveness for assigned responsibilities.
  • Support the Contracts and Procurement Manager as a point of contact in the process of interviewing and communicating with current and prospective vendors to determine performance capabilities.
  • Ensures goods and services are obtained in an effective manner and in compliance with company policies, applicable laws, regulations, grant agreements, APTA, FTA and FRA regulations and other contractual requirements.
  • Works closely with all departments, project managers and the Material Control managers to meet procurement scope requirements such as identification of need, preparing specifications, sourcing qualified vendors, soliciting bid proposals and evaluating submitted proposals.
  • Review the terms and conditions of contracts and negotiate optimal results for the company as well as manage and negotiate contracts with subcontractors and suppliers.
  • Ensure all parties comply with the terms and conditions of a contract, as well as legal regulations and company policies
  • Assess contractor performance: Identify the need for amendments of existing contracts
  • Research regulations to ensure contracts are updated and in compliance with laws
  • Ensure the terms of contractual agreements are written in language that is legally binding and in accordance with the best interests of the company
  • Review contract terms and conditions to verify that they follow company policies and all applicable federal and state regulations
  • Self-monitor progress according to the schedule of completion to submit drafts and documents in a timely manner
  • Proofread, edit, and fact-check legal documents for accuracy and consistency, according to a style guide if provided by the client
  • Ensure compliance with the Davis-Bacon Act, prevailing wage laws, and other relevant regulations.
  • Regular and consistent engagement, participation and promotion of Herzog’s Culture and its essential behaviors are a requirement for this position.
  • Regular and predictable attendance and punctuality are a requirement for this position.
  • Other duties as assigned.

Qualifications:

  • Bachelor’s degree with emphasis in business administration, finance, or accounting.
  • 2 years of experience in contract administration, preferably working directly with contract law
  • Knowledge of current and legally binding contractual language and terminology
  • Experience and knowledge of the railroad industry's concepts, practices, and procedures specifically in procurement and sourcing within a maintenance environment.
  • Working knowledge of Microsoft Office products such Excel and Word, inventory software and the Internet.
  • Excellent interpersonal and communication skills, including an impeccable understanding of the English language
  • Good organization skills and the ability to multitask on several projects simultaneously
  • Knowledge of negotiation best practices, both in-person and in written form, that considers cultural norms and the client's best interests

Pre-Employment Requirements:

  • Subject to pre-employment background check and motor vehicle report review.
  • Subject to pre-employment physical, medical evaluation, and drug screen.
  • Successfully complete and maintain any required safety certification and testing on an annual basis.

  • Must be able to hear and distinguish auditory signals as required by the position.
