The purpose of this position is to perform the essential job duties and functions listed below with the overall objective of helping to improve the Corporation’s overall business performance, deliver added value to our shareholders, , and promote consistent and cost effective solutions across strategic business units, projects, and locations. This position provides oversight for subcontract management activities on Fluor projects or may act as a lead contract manager on individual Fluor contracts. This role is expected to directly supervise Principal subcontract Managers and Contract Administrators and provide project staffing solutions including workforce and indirect estimates. Through assigned contract administrators, this role assures compliance with all statutes, regulations, and contract terms and conditions. The position requires the subcontract manager to report to project, department, and company management on the health of the assigned contract(s); participate in developing and approving contracting strategies generally directly reporting through an intermediate senior contract manager. The individual will review and approve subcontract awards with their delegated authority, generally for mid to large contracts.• Administer moderately large and complex subcontracts• Negotiate subcontract terms and conditions, analyze commercial sections of proposals and technical proposal evaluations, and coordinate of technical scopes of work including interface with all project disciplines (project controls, legal services, project management, construction, engineering, finance/accounting, and client)• Develop final proposal evaluations, prepare subcontract recommendations, and present recommendation to project team and/or client• Support Subcontract Management activities on large-scale projects, with a work scope of US$250 million to US$1 billion (or global equivalent); duties may include assisting multiple Subcontract Administrators and Subcontract Managers with the preparation and execution of pre-award and post-award activities• Conduct and maintain continuing review of progress of each contract and provide management with information pertaining to any financial, technical, or commercial difficulties• Other duties as assigned• Accredited four (4) year degree global equivalent in applicable field of study and ten (10) years of work-related experience or a combination of education and directly related experience equal to fourteen (14) years if non-degreed; some locations may have additional or different qualifications in order to comply with local requirements• Ability to communicate effectively with audiences that include but are not limited to management, coworkers, clients, vendors, contractors, and visitors• Job related technical knowledge necessary to complete the job• Ability to learn and apply knowledge of applicable local, state/province, and federal/national statutes and guidelines• Ability to attend to detail and work in a time-conscious and time-effective manner• Must be able to travel to CONUS and OCONUS work locations up to 25%. Some locations are considered remote and austere. • Experience with contracts utilizing Federal Acquisition Regulation (FAR) and Department of Defense FAR Supplement (DFARS) requirements• Accredited degree or global equivalent in Supply Chain, Business, Construction Management, or Law• Ten (10) years of Subcontract management, subcontract administration, and procurement experience supporting engineering and construction projects• Experience developing negotiating contract terms and conditions specifically for contracts related to services, construction, engineering, materials and equipment installation• Strong understanding of contracting principles and legal terms and conditions• Broad understanding of the US Government Contracting industry and contract language associated engineering, procurement, fabrication, and construction/construction management (EPFC/CM)• Experience with administering the Request for Proposal (RFP) process for contractors on US Government funded projects• Experience with contracts utilizing Federal Acquisition Regulation (FAR) and Department of Defense FAR Supplement (DFARS) requirements• Extensive experience and knowledge in subcontract formation and subcontract administration required• Domestic/international field assignment experience preferred; international project experience preferred• Experience in managing the subcontractor pre-qualification process• Experience in conducting commercial evaluations, including the questions and answers (Q&A) and clarifications process with bidders• Experience in negotiating commercial terms and the final subcontract price with bidders• Excellent communication skills• Perform subcontract risk assessments and formulate mitigation strategies• Audit other projects• Execute portfolio assignments as requested• Prepare Project Subcontract Procedures• Develop standard Subcontract templates for a project• Coordinate the timely issue/distribution/response of documents to the Contractor• Lead internal Request for Proposal (RFP) and RFP explanation meetings, subcontract pre-award meetings, final negotiations, and drafting/finalization of subcontract documents• Perform subcontract management post-award activities through evaluating and status contractors’ productivity, schedule adherence, Subcontract change management, invoicing and claims avoidance• Perform closeout of subcontracts, finalize outstanding contract issues, issue of final modifications, invoices and coordinate completion of subcontractor performance evaluations• Develop and maintain Project Subcontracts Department effort-hour budget• Establish and prepare revised terms and conditions or Special Terms; obtain approval from Legal Services• Perform resource survey• Prepare/issue department/strategic business unit/functional reports• Interface with all levels of the project team – and be able to represent and interface with all levels of internal and/or external management and corporate organization persons; conduct meetings with interfacing disciplines in the support of scope or commercial term development• Be proactive with contractors to ensure contract compliance, generation of progress, schedules, daily and other status reports, invoices, and supporting documents in a timely manner• Provide assistance in Prime Contract Administration as requested• Participate in the development of functional organizational talent through active informal and formal mentoring, prepare performance assessments of Contracts personnel, provide “on-project” functional and cross-functional training• Maintain a working knowledge of the Company’s Contract Management Standards, programs and goals by planning and applying Contract Management practices and procedures as established by the Company on a project site or in an office through departmental training, Fluor University® training and the use of Fluor’s knowledge management portals and communities• Stay current/updated with subcontract Management practices and procedures; remain informed of current developments and potential changes within the subcontract Management group
