EquipmentShare is Hiring a Intellectual Property Attorney

EquipmentShare is seeking a results-driven, experienced attorney to join our legal team and report to our Deputy General Counsel. The Intellectual Property Attorney will be responsible for addressing and/or managing all of the IP needs of the organization, including but not limited to, legal issues related to trademarks, patents, trade secrets, and copyrights, as well as all public-facing marketing materials. This attorney will be embedded with our product development teams (both technology and manufacturing) to act as legal advisor and provide risk guidance. The ideal candidate will have a proven track record in managing and advising on IP matters with a proactive approach to protect the Company's interests.

Primary Responsibilities
  • Coordinate with outside counsel on various IP matters involving copyrights, patents, trademarks, and trade secrets
  • Advise and counsel employees in the product development teams regarding legal compliance and risk management
  • Advise and counsel employees on various marketing-related matters, including name-logo-slogan approval, waivers, contest language, website copy and disclaimers, etc.
  • Draft, negotiate, interpret, and advise employees on IP-related agreements (license agreements, joint development agreements, invention disclosures, etc.)
  • Negotiate, interpret, and advise employees on IP provisions in commercial agreements, such as manufacturing, SaaS, and supply agreements
  • Work with outside counsel to evaluate inventions to determine patentability and draft, file, and prosecute patent applications before the USPTO and foreign counterparts
  • Work with the relevant stakeholders to develop and write policies such as open source policy, AI policy, etc.

Skills & Qualifications
  • Juris Doctor degree
  • Requires membership in a State Bar as an attorney qualified to practice law in the State and must remain in good standing with the State Bar including being current on any applicable Continuing Legal Education requirements
  • Must have 5 years of experience as an IP attorney, including experience with counseling clients on business aspects of IP matters, with in-house experience highly preferred
  • Ability to operate with significant independence
  • Ability to interact with people at all levels of the organization and interface effectively with leadership, internal business partners, and external partners, such as outside counsel
  • Ability to thrive in a high-pressure, fast-paced work environment with strict deadlines
  • Adaptable to growth and changes in the organization, role, and systems
  • Excellent organizational skills and attention to detail
  • Strong time management skills
  • Outstanding written and verbal communication skills, with the ability to articulate legal strategies and courses of action
  • Exceptional presentation and negotiating skills
  • Ability to perform complex tasks and to prioritize multiple projects
  • Demonstrates superior judgment, integrity, and the highest ethical standards
  • Ability to identify problems or inefficiencies and independently offer/implement practical solutions
  • Extensive computer skills including proficiency in Microsoft Office Suite and willingness to learn and adapt to new systems and productivity tools
  • Licensed before the USPTO a bonus, but not required
