Summary
The Associate Director of Appellate Review Programs (ARP) manages the EEOC's national federal sector appeals program. The Associate Director position is designated as SES, General. EEOC structures its SES positions into position levels. This is a position level two with an initial onboarding salary range of $191,900 - $210,217 per year. Exceptions to the salary cap may be considered in certain circumstances. SES employees are eligible to receive performance-based bonuses and salary adjustments.

Duties
  • Manages short and long-range planning and policy development for the agency's administrative appeals program; determines program priorities; and revises and ensures the legal correctness of federal sector decisions.
  • Directs the work of Appeals Divisions and Branches, and determines and implements policies regarding the effective, efficient, expeditious and consistent processing of cases.
  • Recommends statutory changes or other changes that may be needed concerning administrative appeals.
  • Represents the Program at Agency and external meetings and speaks for the Director and the Commission on federal administrative appeals matters.
  • ARP reviews appeals from final agency decisions of complaints of employment discrimination of federal employees and applicants for federal employment and handles petitions for review of decisions by the MSPB on employment discrimination issues.

Qualifications
As a basic requirement for entry into the SES, you must provide evidence of progressively responsible leadership experience that is indicative of senior executive level management capability; and that is directly related to the skills and abilities outlined under the Executive Core Qualifications (ECQs) and the Technical Qualifications (TQs) listed under "How You Will Be Evaluated." Typically, experience of this nature will have been gained at or above the GS-14/15 grade level in the Federal service or its equivalent with state or local government, the private sector, or non-governmental organizations.
To meet the minimum qualifications for this position, you must have earned a professional law degree (J.D. or LL.B.) from a law school accredited by the American Bar Association, be an active member of a Bar, and you must possess all of the mandatory Executive Core Qualifications and Technical Qualifications listed below. These qualifications would typically be acquired through education, experience, and training which reflect progressive development and achievement in managing a comprehensive business program in a complex organization. An individual's total experience and education must demonstrate the ability to perform the duties of the position. Applicants must meet all of the qualification requirements by the closing date of this announcement.
Senior Executive Core Qualifications:

Leadership Competencies: Accountability, Customer Service, Decisiveness, Entrepreneurship, Problem Solving and Technical Creditability.
ECQ 4 - Business Acumen: The ability to manage human, financial and information resources strategically. Leadership Competencies: Financial Management, Technology Management and Human Capital Management.
ECQ 5 - Building Coalitions: The ability to build coalitions internally and with other Federal agencies, State and local governments, nonprofit and private sector organizations, foreign governments, or international organizations to achieve common goals. Leadership Competencies: Influencing/Negotiating, Oral Communication, Partnering and Political Savvy.
NOTE: Responses to ECQs must not exceed 10 pages typed in 12-point font.
Technical Qualifications (TQ):
In addition, all applicants must submit a written narrative response to the following TQ(s). Please give examples and explain how often you used your skills, the complexity of the knowledge possessed, the level of people you interacted with, the sensitivity of the issues you handled managing a large public or private sector organization that administers complex, rules-based benefits or services, etc.
1. Extensive knowledge of programmatic, human resources, budget, and administrative management techniques and practices sufficient to accomplish national organizational mission objectives within a public environment.
2. Extensive knowledge of rules, regulations and/or procedures related to Title VII of the Civil Rights Act of 1964, as amended; the Age Discrimination in Employment Act of 1967; the Americans with Disabilities Act of 1990; the Rehabilitation Act of 1973, the Equal Pay Act of 1963, the Genetic Information Nondiscrimination Act of 2008; the Elijah E. Cummings Federal Employee Antidiscrimination Act of 2020; and the Pregnant Workers Fairness Act of 2022.
3. Extensive knowledge and legal experience of the adversarial judicial system and legal processes, including knowledge necessary to interpret laws, analyze facts and to render legally sufficient and defensible decisions in cases that involve, among other elements, a review of hearings, trials, oral and written arguments, offers of settlement, rulings on motions, pre-hearing conferences, briefs, final decisions, etc.

Background Investigation: This position requires that a background investigation be conducted and favorably adjudicated in order to establish security eligibility.

How You Will Be Evaluated
You will be evaluated for this job based on how well you meet the qualifications above.

How you will be evaluated:
The servicing Human Resources Specialist will forward all minimally qualified applicants to be evaluated by an Executive Resources Board (ERB) rating panel of senior managers to determine the degree to which they possess the executive core and professional/technical qualifications, and best qualified candidates may undergo an interview and a reference check. The ERB rating panel will make recommendations on best qualified candidates to the appointing authority.
