Under the general direction of the Assistant Chief Counsel of the Rate Enforcement Bureau, and reporting to the Deputy General Counsel of Litigation and the General Counsel of the Legal branch, the Attorney V handles the most complex and sensitive cases involving Proposition 103, including insurance rating and underwriting as well as noncompliance actions. The Attorney V represents the Department in difficult administrative hearings over alleged violations of California law by insurance companies. The Attorney V works independently, with broad discretion, handling the most complex and difficult tasks requiring detailed knowledge of, and great experience in, litigation, legal discovery, insurance, contracts, and business law, as well as actuarial, economic, scientific, and financial matters. Controls and advises outside counsel in complex litigation when the Department retains outside counsel. Conducts the most difficult legal research and negotiates as the Department’s representative in the most complex cases. Drafts legislation and represents the Commissioner in legislative hearings with regard to the most sensitive, difficult, and complex legislation. Provides legal opinions to the various branches of the Department regarding the most difficult and novel legal issues involving insurance rating and underwriting, including issues involving insurance availability and affordability. Drafts regulations, and supporting materials, and conducts rulemaking proceedings for the adoption of the most sensitive and complex Department regulations. When appropriate, recommends the holding of investigatory hearings and presides at those hearings.
