GENERAL SUMMARY:
Summary:
Coordinates legal services provided to Bayhealth Medical Center and related corporations; coordinates the contract management program; provides legal advice and counsel for hospital operations, corporate, and medical staff issues. Drafts contracts for use by various departments; drafts, files, presents guardianship petitions for Bayhealth Medical Center patients; reviews and revises contracts from vendors; prepares, drafts, and litigates debt actions, mechanics liens, and arbitration matters. Reports to the Associate General Counsel.
ESSENTIAL FUNCTIONS & ACCOUNTABILITIES:
1. Actively participates in the contract management program and processes. Works with external counsel to provide efficient and effective legal management for the corporate client.
2. Within contract management program, responsible for reviewing existing agreements for Stark, Anti-kickback, and False Claims Act compliance and developing standardized language for purchasing agreements.
3. Develops and presents in-services and other educational programs for Bayhealth employees on pertinent legal issues.
4. Provides advice and recommendations on the handling of all actual or threatened professional and general liability claims.
5. Provides legal representation for miscellaneous legal issues, including, but not limited to, Motions for Protective Orders and Motions to Quash Subpoenas.
6. All other duties as assigned, within the scope and range of job responsibilities.
REQUIRED MINIMUM EDUCATION AND CREDENTIAL:
- Education Juris Doctorate
Law - Credential License to practice law in Delaware within 24 months of hire
EXPERIENCE:
Required: Five years legal experience, either in a law firm or an in-house legal department
Preferred: Five years’ experience as legal counsel in the healthcare industry
