BAYADA Home Health Care is currently seeking an experienced Director of Compliance.

The Compliance Director, is responsible for oversight of Compliance Office operations, including the compliance hotline, incidents and complaints, exclusion screening, policy maintenance, education and trainings, contract review and meeting preparation.

RESPONSIBILITIES:

  • Demonstrate and communicate the core values of BAYADA and The BAYADA Way.
  • Develop working knowledge of BAYADA’s mission, services, people, organization, policies and procedures.
  • Monitor and identify potential areas of compliance vulnerability and risk; provide advice on corrective action plans for resolution of problematic issues; provide general guidance on how to avoid or deal with similar situations in the future.
  • Review audit requests from external regulatory and accrediting bodies; provide guidance to Compliance Office team members regarding responses and appeals; negotiate with payors and government entities as needed in collaboration with the Chief Compliance Officer, Division Director, Compliance, and the Legal Services Office as needed.
  • Interpret relevant laws, statutes, and policies governing the implementation of an adequate and effective Compliance Program based on OIG guidance.
  • Manage Senior Manager(s) and assist Senior Manager in management of Senior Associate(s) and Associate(s) in their day-to-day work, which includes operation of Compliance hotline and incident management system.
  • Manage tracking and reporting system for compliance with laws and regulations and internal questions and responses to the same as they arise.
  • Conduct operational, regulatory, and other research as requested or needed.
  • Monitor federal, state, and local regulatory standards, Medicare Conditions of Participation, Medicaid rules, state licensure requirements, and other laws and regulations as necessary and assist the team with communicating changes throughout the organization.
  • Assist the Senior Manager and other roles within the office with the development and revisions to policies and procedures for the general operation of the Compliance Program and its related activities to prevent illegal, unethical, or improper conduct. Forge consensus on Compliance policy positions and responses to proposed regulations.
  • Assist with the development of training and education materials and education related to the Compliance Program (including Standards of Honesty and Confidentiality and Code of Ethics) based upon the needs of the organization and with changes in laws, regulations, and guidelines of federal, state, and private payors.
  • Collaborate with other departments to direct and resolve compliance issues through appropriate channels for investigation and resolution.
  • Under the general direction of the Division Director, Compliance, and Chief Compliance Officer, conduct investigations of compliance violations and matters related to compliance as they arise and design and coordinate internal investigations necessary to determine if a breach of the compliance program has occurred and the necessary actions to be taken to resolve the matter. Respond to government investigations and queries in concert with the Chief Compliance Officer and Division Director of Compliance.
  • Ensure proper reporting of violations or potential violations to duly authorized enforcement agencies as appropriate and/or required. Under the direction of the Chief Compliance Officer and Division Director, Compliance, facilitate communication and negotiation with external regulatory bodies (ex. OIG) for proper response, reporting and resolution.
  • Maintains effective compliance communication, including promoting heightened awareness of compliance standards and new and existing compliance issues and related policies and procedures.
  • Demonstrate solid performance or exceed performance standards in key job dimensions/attributes as defined on the Performance Appraisal for Office Staff.
  • Perform related duties, or as required or requested by supervisor.

OTHER RESPONSIBILITIES:

  • Adept at addressing ethics, compliance, and client matters in a big-picture context based on applied principles.
  • Ability to command respect because advice and analyses are incisive, well-reasoned, and timely provided.
  • Work collaboratively with Enterprise Support and Service offices, Enterprise and Service Divisions, and other departments to ensure alignment and standards are followed and enforced.

MINIMUM QUALIFICATIONS:

  • Exemplifies characteristics of The BAYADA Way: compassion, excellence and reliability.
  • Four (4) year college degree. Juris Doctor or Advanced Degree in Healthcare preferred.
  • Five (5) to seven (7) years of work experience in a compliance function, preferably with a home health or healthcare organization.
  • Executive presence to represent BAYADA Home Health Care internally and externally.
  • A working understanding of the home health industry's legal and regulatory system, including the various organizations that administer the regulations, statutes, and related guidance.
  • Ability to work closely with Compliance team members, other Enterprise Support, Executive and Practice leadership, senior management, and service offices to support the organization's overall strategy.
  • Ability to focus on opportunities for efficiency to maintain program agility and effectiveness.
  • Holds the leadership skills necessary to foster working relationships with various departments within the organization and lead initiatives with cross-functional teams.
  • Ability to simultaneously manage multiple projects effectively and respond to urgent matters promptly and concisely.
  • Ability to work independently, motivate and be self-motivated, flexible, versatile, and creative.
  • Ability to confidently and comprehensively undertake critical analysis of complex issues and provide comprehensive guidance and recommendations with both compliance and overall business impact in mind.
  • Possess problem-solving ability and leadership skills and be able to foster interpersonal relationships.
  • Must be able to write reports, business correspondence, and procedure manuals and effectively present information and respond to questions from groups of employees, managers, directors, and clients.
  • Demonstrated record of strong interpersonal skills.
  • Competence in basic PC skills required to perform job functions.
  • Ability to work successfully and productively both remotely and in the office.
  • Acceptable pre-employment assessment results.
  • Ability to read, write and effectively communicate in English.
