As a reflection of our current needs and planned growth we are very pleased to offer a new opportunity to join our dedicated team as Sr. Corporate Counsel to support our internal teams in addressing privacy compliance and healthcare regulatory matters. This position will report to the Vice President, Associate General Counsel. The successful candidate will have experience in all aspects of data privacy matters and compliance, including developing privacy policies, processes, standards, and guidelines and handling privacy incidents, inquiries, and escalations. The ideal candidate will also have experience advising providers in healthcare regulatory matters, including the Anti-Kickback Statute, Stark Law, HIPAA/HITECH, corporate practice issues, and state healthcare laws.

Responsibilities

  • Draft, review, and negotiate privacy agreements, including data protection agreements and data protection aspects of other enterprise agreements.
  • Proactively work with cross-functional stakeholders to assess areas of improvement related to privacy.
  • Take a practical problem-solving approach to efficiently assess privacy issues while advising business leaders on acceptable risk.
  • Assist in creating and improving our form agreements, including Business Associate Agreements, and playbooks, as needed.
  • Serve as subject matter expert on federal and state healthcare regulatory issues, including fraud and abuse counseling (including the Anti-Kickback Statute and Stark Law), HIPAA and False Claims Act, and their state analogues.
  • Work closely with other attorneys and TAG’s senior management team and other key leaders to protect the legal interests of WellNow as a trusted advisor.
  • Provide legal advice and support in day-to-day operations, transactions, acquisitions, payor strategies, and the Company’s efforts to expand service lines and territories;
  • Review, draft, and negotiate a wide range of legal documents and commercial contracts, including service agreements, vendor contracts, payor contracts, and other agreements that will meet the Company’s business needs.
  • Ensure compliance with regulations and legal requirements relating to the Company’s role as a provider of non-clinical business support services to urgent care practices.
  • Keep abreast of relevant legislative and regulatory developments, apprise senior management and supported departments in a timely manner.
  • Occasionally consult with outside counsel on complex privacy and healthcare regulatory issues.

Minimum Education Requirements

The successful candidate will hold a law degree from an accredited and well recognized law school and an undergraduate degree from a college or university of recognized standing. He/she will be licensed in good standing to practice law in one or more jurisdictions within the United States and, if not licensed to practice law in New York or Illinois, shall be qualified to serve as in house counsel pursuant to the rules of the New York State Bar Unified Court System or Illinois Board of Admissions to the Bar, respectively.

Professional Qualifications - Experience

  • Successful track record of at least four to six years of experience gained through private practice, in-house corporate legal department, or a combination of both. Previous substantive experience in complex privacy healthcare regulatory matters is required.
  • In-Depth knowledge of worldwide data protection regulations, including GDPR, CCPA, and industry-specific regulations·
  • Working knowledge of cybersecurity concepts and proven experience working closely with security teams.
  • Deep knowledge of healthcare laws and regulations, including the Stark Law, Anti-Kickback Statute, HIPAA, False Claims Act and state analogues.
  • Working knowledge of billing and coding and revenue cycle management a plus
  • Outstanding oral and written communication skills
  • Demonstrated experience working with management as a business partner and legal counsel, ability to think like an operator and integrate legal and business solutions in a fast-paced environment.
  • Ability to quickly, confidently, and comprehensively assess a situation, diffuse distraction, and generate new insights, practical solutions and drive an action plan.
  • An ability to communicate in a clear, concise, understandable manner and convey complex and high-risk matters in a manner useful and productive to management decision-making.
  • Ability to present with confidence to a broad constituency.

Salary: $150-175k with bonus opportunity
