The State of New Hampshire, Commission For Human Rights has a full-time vacancy for an Anti-Discrimination Investigator.

Summary:

Investigates charges of discrimination in employment, housing and public accommodation in order to enforce state law by collecting and analyzing evidence, interviewing witnesses, and applying facts to law, culminating in written court-worthy reports which recommend probable cause or no probable cause findings of discrimination to Commissioner. On behalf of the Commission, conducts public outreach on the law against discrimination.

YOUR EXPERIENCE COUNTS : Each additional year of approved formal education may be substituted for one year of required work experience and/or each additional year of approved work experience may be substituted for one year of required formal education.

MINIMUM QUALIFICATIONS:

Education: Bachelor's degree from an accredited institute of higher education. Each additional year of approved formal education may be substituted for one year of required work experience.

Experience: Four years of experience in fair employment practices, social work, pre-law, human resources or related field. Each additional year of approved work experience may be substituted for one year of required formal education.

License/Certification: None required.

RECOMMENDED WORK TRAITS: Thorough knowledge of approved principles, practices and procedures of investigatory work. Knowledge of the United States Civil Rights Act of 1964, state anti-discrimination laws, Title VII (E.E.O.C.) compliance procedures, Title VIII of the Civil Rights Act of 1968 (Fair Housing), the Age Discrimination in Employment Act of 1967, the Genetic Information Non-Discrimination Act, the Equal Pay Act, and the Americans with Disabilities Act, as amended. Knowledge of current anti-discrimination court decisions. Ability to compile evidence. Ability to demonstrate objectivity and fairness in dealing with complainants and respondents and/or their agents. Ability to provide clear and concise reports. Must be willing to maintain appearance appropriate to assigned duties and responsibilities as determined by the agency appointing authority.

Responsibilities:

Screens public inquiries to determine individuals’ eligibility to file charges of discrimination based on legal standards and jurisdiction; drafts formal charges of discrimination consistent with specific legal criteria which includes entering case information into federal database; prepares amendments to charges, reviews motions and interrogatories, and drafts orders.

Defines scope of investigation by developing a case plan; identifies the applicable legal standard(s) & affirmative defenses; develops a timeline of chronological events; determines what evidence will be sought and identifies witnesses who will be interviewed; develops a timeline by which a case will be investigated and concluded.

Manages active caseload in differing stages of investigation to ensure compliance with federal contract deadline.

Interviews parties and interested persons involved in discrimination complaints to verify case information and clarify legal issues; collects, reviews and analyzes statistical documentation and evidence; monitors employment, housing and business practices to determine if systematic discrimination exists.

Conducts legal research by reviewing court decisions and analyzing statutes, rules, and regulations; monitors pending federal and state legislation and administrative rule revisions.

Writes clear and accurate reports based upon analysis of relevant facts, findings, and federal and state law, subject to review by the Executive Director; makes recommendations to Commissioner(s) for final decision based on findings in investigative reports.

Facilitates settlement negotiations or refers cases to mediation when appropriate; conducts pre-determination conferences; caucuses cases.

Promotes good will and prevents discrimination by conducting outreach and education; attends state-wide events, participating in and assisting in organizing conferences, collaborates with community partners and state and federal agencies; provides referrals; answers public inquiries regarding compliance with anti-discrimination laws; provides education on civil rights laws, statutes, and regulations for members of the public.

Attends and participates in trainings for continuing education.
