About the role:

Lead the commercial architecture for Portsmouth Power. This role owns the commercial strategy and major agreement framework across EPC/EPCM contracting, owner services, offtake/customer arrangements, power sales or energy services structures, commercial risk allocation, contract governance, negotiation strategy, and alignment with finance, legal, procurement, engineering, and delivery.


Office Location: We are hiring for this position in NY and CA and are also open to candidates located in Ohio or Texas. Compensation may vary depending on geographic location, experience, and other job-related factors.


What success looks like in the first 6-12 months

  • Commercial strategy and contracting roadmap established for the first execution wave, including contract packaging, risk allocation, compensation models, approval thresholds, and negotiation priorities.
  • Clear division between Commercial/Contracts/Offtake and Procurement established to avoid gaps or duplication.
  • Standard owner commercial positions, templates, fallback positions, and approval workflow aligned with legal and executive leadership.
  • Key commercial risks documented and connected to project cost, schedule, financeability, constructability, and delivery risk.
  • Offtake/customer commercial assumptions translated into project requirements, delivery obligations, and risk allocation.


Key responsibilities

  • Own the Portsmouth commercial and contracts strategy across EPC/EPCM, Owner Engineer, PMO, major consultants, long-lead equipment packages, offtake/customer arrangements, utility interfaces, and enabling works as applicable.
  • Develop recommended contracting models, compensation structures, risk allocation positions, commercial fallback positions, and approval thresholds for GM and executive decision-making.
  • Lead negotiation strategy for major agreements in partnership with Legal, Finance, Procurement, Engineering, Program Delivery, and executive sponsors.
  • Own the commercial interface with offtakers, tenants, hyperscaler/customers, utilities, and strategic counterparties where project delivery obligations, pricing, availability, performance, cost recovery, or risk allocation are affected.
  • Ensure contracts position the execution team for success by aligning scope, schedule, performance requirements, liquidated damages, incentives, warranty, change, claims, insurance, safety, QA/QC, reporting, and interface obligations.
  • Review and approve procurement strategy, contract packaging, bid evaluation commercial criteria, award recommendations, and contract deviations for major packages in coordination with Procurement.
  • Build and operate contract governance, including contract compliance, change/claims strategy, notices, amendments, dispute avoidance, and commercial risk reporting.
  • Translate commercial and offtake assumptions into impacts on engineering basis, construction sequencing, commissioning, operations readiness, and finance/investment materials.
  • Support investment committee and board materials with commercial risk analysis, contracting strategy, major deal terms, and execution implications.
  • Build future commercial/contracts capability as the program scales, including contract administration, claims avoidance, offtake management, and commercial governance.
  • Travel as required.

  • GM, Program Delivery/Integration, Program Controls, Engineering & Technical, Procurement, Gas/Fuel Supply, Legal, Finance, Insurance, Government Affairs, and external advisors.
  • EPC/EPCM contractors, OEMs, Owner Engineer, PMO, utilities, strategic vendors, offtakers/customers, tenants, and potential partners.
  • Executive leadership and investment committee stakeholders for major commitments and commercial risk decisions.


Required qualifications

  • Bachelor degree in business, engineering, finance, economics, construction management, supply chain, law, or related field.
  • 15 years of commercial, contracts, business development, project development, procurement, energy transactions, or major capital project contracting experience.
  • Demonstrated experience negotiating and managing high-value contracts for power, oil and gas, utilities, infrastructure, industrial, technology infrastructure, or comparable capital-intensive businesses.
  • Strong understanding of EPC/EPCM contracting, professional services agreements, procurement terms, change/claims, risk allocation, warranties, performance obligations, and approval governance.
  • Experience translating commercial strategy into project execution implications, including cost, schedule, technical risk, financing, and operational obligations.
  • Strong negotiation, executive communication, and stakeholder management capability across legal, finance, engineering, procurement, project delivery, and external counterparties.
  • Commercial judgment to recognize when a low-price bid, aggressive schedule, or unfavorable risk transfer creates hidden delivery risk.
  • High integrity and strong understanding of governance, confidentiality, conflicts, delegations of authority, and contracting compliance.


Preferred qualifications

  • Experience with power purchase agreements, energy services agreements, tolling agreements, capacity/resource adequacy contracts, fuel supply arrangements, interconnection-related agreements, or large customer/offtake structures.
  • Experience with gas-fired generation, transmission, renewable/storage development, data centers, hyperscaler infrastructure, midstream gas, LNG, or industrial energy supply.
  • MBA, JD, MSc, or equivalent advanced commercial/legal/finance education.
  • Experience working in an owner/developer organization with board/investment committee governance.
  • Experience in PJM, ERCOT, MISO, CAISO or comparable RTO/ISO markets.
  • Experience with international suppliers, major OEMs, constrained supply chains, and long-lead equipment commercial strategy.
