This role focuses on representing plaintiffs in "Lemon Law" disputes against major automotive manufacturers. The ideal candidate will manage a dedicated caseload from initial intake through settlement or trial, ensuring that consumers are fairly compensated for defective vehicles.
ESSENTIAL RESPONSIBILITIES
- Case Evaluation & Intake: Review repair histories, warranty documents, and service records to determine if a vehicle meets the legal "presumption" of a lemon under California lemon law.
- Litigation Management: Manage all phases of civil litigation, including drafting and filing complaints, propounding and responding to discovery, and drafting "meet and confer" letters.
- Law & Motion: Draft and argue high-stakes motions, including Motions to Compel, Oppositions to Summary Judgment, and Motions for Attorney’s Fees.
- Depositions: Lead and defend depositions of plaintiffs, dealership service technicians, and manufacturer corporate representatives (PMKs).
- Negotiation & Settlement: Negotiate favorable "buyback" or "cash-and-keep" settlements. Calculate complex damages including registration fees, taxes, finance charges, and "mileage offsets" per Civil Code § 1793.2(d)(2)(C).
- Technical Oversight: Attend vehicle inspections with expert mechanics and engineers to verify nonconformities and "substantial impairment" of use, value, or safety.
- Trial Advocacy: Act as lead or second-chair counsel in jury trials, preparing trial briefs, motions in limine, and witness examinations.
- The responsibilities and tasks are not an exhaustive list and may vary in terms of case responsibilities.
REQUIREMENTS
- Licensure: Active member in good standing with the State Bar of California (required).
- Experience: 1 years of civil litigation experience. Specific experience in Lemon Law or consumer warranty litigation is highly preferred.
- Legal Knowledge: Proficiency in the California Code of Civil Procedure and specific knowledge of the Song-Beverly Act (Civil Code § 1790 et seq.)
- Analytical Skills: Ability to analyze complex mechanical repair orders and translate technical defects into persuasive legal arguments.
- Communication, Oral and Written: Exceptional writing skills and the ability to explain complex legal rights to clients who are often frustrated by their vehicle issues.
- Detailed oriented: hard-working and business minded. Excellent organizational skills and ability to handle multiple priorities simultaneously. Ability to work under pressure and to handle work-related weight.
- Customer service oriented: Able to work independently and productively with minimum supervision. Aptitude to identify and assess legal and business risks.
