Position Overview
We are seeking an experienced Employment Litigation Attorney to represent employers and employees in complex workplace disputes across federal and state courts, arbitration panels, and administrative forums. The successful candidate will manage matters from intake through trial and appeal, handle investigations and compliance counseling, and deliver strategic, client-focused solutions in areas including wrongful termination, discrimination, wage-and-hour claims, trade secret disputes, and contract-related issues.
Key Responsibilities
- Manage a full caseload of employment litigation matters in state and federal court, arbitration, and administrative agencies from intake through resolution or appeal.
- Conduct factual and legal investigations, including witness interviews, evidence preservation, and document collection.
- Prepare and defend depositions; prepare witnesses for testimony and trial.
- Draft and file pleadings, motions, briefs, and oppositions; conduct motion practice and oral argument.
- Develop and execute discovery strategies, including e-discovery protocols, document review, and privilege logs.
- Lead settlement negotiations, mediate disputes, and represent clients in arbitration and alternative dispute resolution proceedings.
- Handle trial preparation and trial advocacy, including jury selection, opening/closing statements, exhibits, and trial examination.
- Provide counseling to clients on employment policies, severance agreements, employment contracts, non-compete agreements, NDAs, and compliance matters.
- Advise on and litigate trade secret, restrictive covenant, and other contract-based disputes.
- Address specialized regulatory issues including ERISA, OSHA, wage-and-hour, and I-9/Immigration compliance matters.
- Collaborate with in-house counsel and HR to develop proactive risk-reduction strategies and internal investigation protocols.
- Manage case budgets, billing, and client communications; supervise associates and paralegals and oversee case management and document review workflows.
- Maintain up-to-date legal research and produce clear, persuasive legal writing for motions, memos, and client advisories.
- Ensure preservation of privilege and confidentiality and implement effective privilege and data protection protocols.
Qualifications
- Juris Doctor (JD) degree from an accredited law school and admission to the WSBA.
- 3 years of litigation experience with a focus on employment law; trial experience strongly preferred.
- Demonstrated experience in motion practice, pleadings, discovery management, and e-discovery tools.
- Proven deposition and trial advocacy skills; experience preparing witnesses for testimony.
- Strong legal research and writing abilities with a record of persuasive briefs and motions.
- Knowledge of federal and state employment laws, including wrongful termination, discrimination, harassment, FLSA/wage-and-hour, and leave laws.
- Experience with severance agreements, employment contracts, non-compete agreements, NDAs, and trade secret litigation.
- Familiarity with ERISA, OSHA, and I-9/Immigration compliance issues a plus.
- Skilled in arbitration, mediation, and settlement negotiation; comfortable with alternative dispute resolution processes.
- Excellent client counseling, interpersonal, and communication skills; ability to manage sensitive matters with discretion and professionalism.
- Strong organizational skills, attention to detail, and experience with case management and document review platforms.
- Ability to supervise junior attorneys and support staff and contribute to business development efforts as needed.
- Willingness to travel for court appearances, depositions, and client meetings when required.
