Assistant Prosecuting Attorney II

The Assistant Prosecuting Attorney II will represent the State of Missouri and Clay County in all aspects of the criminal justice process. Prosecutes misdemeanor and felony criminal charges, including case reviews and investigation, filing of appropriate charges, and case and trial preparation. Communicate with law enforcement officers on investigations, testimony, and trial preparation. Conduct preliminary hearings, motion hearings and trials in associate circuit and circuit court. Works under the general supervision of the Elected Prosecuting Attorney, according to an established work routine

 

Essential Duties and Responsibilities:

  • Review prospective cases and determine appropriate charges
  • Assist in the preparation of case files, filing of criminal charges and disposing of charges through pleas or trial
  • Provide case related legal advice to law enforcement officials
  • Appear in court for docket dates, motion, and trial hearings
  • Communicate with victims and witnesses on case related issues and updates
  • Negotiate criminal plea recommendations with defense attorneys
  • Conduct post-conviction motion hearings and misdemeanor appeals as necessary
  • Handle after hour calls or duties on a rotating basis
  • Provide backup to related positions and perform other related duties as assigned and reasonably qualified to perform


Knowledge, Skills and Abilities:

  • Working knowledge of criminal law, trial techniques and procedures, rules of evidence and criminal procedure
  • Ability to effectively meet and deal with the public
  • Ability to communicate effectively verbally and in writing
  • Ability to handle stressful situations
  • Ability to objectively evaluate each case and communicate with opposing counsel and witnesses
  • Ability to use computers and electronic data processing equipment, phone; copy machine; and fax machine
  • Experience using databases, spreadsheets, and other general office forms


Minimum Qualifications:

  • Doctor of Jurisprudence
  • License to practice law in the state of Missouri
  • Member in good standing with the Missouri Bar
  • At least three years of experience handling Jury and Bench Trials
  • Intermediate to expert working knowledge of MS office products and other office equipment including fax, copier, etc.
  • Must be able to communicate professionally and effectively, using written and oral communication, with all levels of staff and the public 
  • Knowledge of department policies and procedures
  • Must be able to speak, read and understand English
  • Must be lawfully licensed and insured to operate a motor vehicle. 


Minimum Qualifications:

  • Experience as First Chair on several Class A and B felonies.
  • Familiarity and experience with post-conviction relief motions.

  • Sufficient vision or other powers of observation, with or without reasonable accommodation, which permits the employee to comprehend written work instructions and review, evaluate and prepare a variety of written/typed documents and text materials. Specific vision abilities required by this job include close vision and the ability to adjust focus.
  • Sufficient manual dexterity, with or without reasonable accommodation, which permits the employee to operate standard office equipment and personal computers.
  • Sufficient personal mobility, flexibility, and physical reflexes, with or without reasonable accommodation, which permits the employee to lift up to 15 pounds, to sit and work at a keyboard for an extended period of time, and work in an office environment.
