The City of Boise is hiring an Attorney II for our Municipal division!

Join the City of Boise as an Attorney II – Municipal and provide legal counsel to city departments, boards, and commissions on a broad range of municipal law matters. This position advises internal clients on issues including open meetings, public records, contracts, ordinances, governance, and administrative proceedings, while also conducting legal research, drafting memoranda and legal documents, negotiating agreements, and representing the City in selected civil and administrative matters. Working under general supervision, this role is well suited for an attorney with a solid foundation in legal practice who is ready to take on varied and increasingly complex municipal work in a collaborative public service environment.

Essential Functions

Performs all duties of Attorney I - Municipal, in addition to providing team support and training of lower-level municipal attorneys; performs both routine and more complex tasks, and assists others as required.

Provides internal client representation, advice and counsel. Assists more senior attorneys in advising internal clients. Some positions will be assigned a department, board or commission as an internal civil client for whom the attorney is expected to provide advice on open meetings law, public records law and basic meeting processes, including parliamentary procedures. Drafts advice memoranda for department heads or the City Attorney. Conducts research and drafts ordinance amendments and new ordinances.

Develops internal training materials for the police and general city employees. Provides internal clients with on-call assistance and after-hours advice, and attends meetings to advise the boards and commissions during business and non-business hours. Represents the city at civil and administrative hearings. Drafts advice memoranda to the mayor and city council on behalf of internal clients. Negotiates and reviews city contracts for compliance with purchasing laws, regulations and requests for purchasing agreements, procedures and policies. Advises clients on the legal implications of business decisions.

Civil Focus: Areas of emphasis may include contract, code, ordinance and resolution writing; real property transactions; legal research and writing assignments; code fees and fines projects; and attending meetings associated with city clients, including those of the internal boards and commissions.

Public Safety Focus: Areas of emphasis may include providing extensive legal advice and training for the police, fire and code enforcement departments; processing public records requests and properties and weapons dispositions; reviewing code compliance and enforcement issues; providing advice to police officers seeking criminal arrest warrants, search warrants, and magistrate inquiries; and providing backup to the criminal prosecution team and serving as an on-call advisor for the police.

Areas of emphasis may include all aspects of civil litigation from case inception through trial and appeal.

Requirements

Required Knowledge, Experience, And Training

Juris Doctorate degree from an accredited law school and two years of experience in civil or criminal litigation, or municipal governance.

Knowledge Of:

  • Principles of civil and criminal law, court rules and trial procedures, rules of evidence, rules of professional conduct, parliamentary procedure and legal ethics
  • Organizational and departmental operations, services, procedures and policies
  • Federal laws relating to housing, landlord and tenant laws
  • Computer usage including related software.

Ability to:

  • Write briefs, memoranda, contracts and other complex legal documents
  • Navigate federal laws to research particular issues that may arise
  • Analyze complex legal issues and conduct research
  • Communicate information about moderately complex criminal and/or civil issues
  • Communicate effectively in the English language at a level necessary for efficient job performance
  • Perform all essential functions as assigned by an authorized employee, supervisor and/or manager with or without a reasonable accommodation.

Individuals must be capable of operating vehicles safely and have an acceptable driving record.

Preferred Knowledge, Experience, And Training

Four years of previous experience in a law office, managing a significant case load; demonstrated researching and writing experience drafting memoranda, legislation, ordinances and contracts; and experience advising a legal entity, association, board, commission or committee.

Knowledge Of:

  • Idaho open meetings and public records laws
  • Robert's Rules of Order
  • Idaho municipal law

Licensing And Other Requirements

Licensed and active member of the Idaho State Bar in good standing.

Valid state-issued driver’s license.

City of Boise background check processes which includes a criminal history check and reference checks in accordance with the City of Boise Hiring Process Regulation

Physical Efforts

While performing the duties of this job the employee is occasionally lifting/carrying up to 10 pounds. Also, the employee is frequently pushing/pulling up to 10 pounds and occasionally pushing/pulling up to 20 pounds. The noise level is occasionally moderate. Work includes sensory ability to talk and hear. Work in this position also includes close vision. Employees will sit, stand and walk.

Working Environment

The work environment will include inside conditions. Employees will also drive a vehicle as part of this position.

This position works: outside of, or extends beyond, a typical 8am to 5pm M-F work week, as required.
