GENERAL DESCRIPTION
Maintains, upholds, and enforces Tribal Employment Rights Office (TERO) law by actively facilitating participating in meetings and monitoring compliance of all assigned projects for Cherokee Nation and Cherokee Nation Entities.

Must possess a valid driver's license with a driving history verified through a motor vehicle report that meets requirements for Cherokee Nation underwriting rating.

Responsibilities:
ESSENTIAL DUTIES AND RESPONSIBILITIES
- Attends meetings (Pre-bid, Bid Openings, Pre-Construction, De-Scopes, OAC, Architect) with internal and external departments and contractors throughout the duration of a job.
- Attends Pre-bid meetings with vendors interested in securing projects open for bid.
- Actively participates in Pre-bid meetings by communicating compliance criteria including Davis Bacon Wage Act to potential contractors vetting services during the bidding process.
- Provides mediation between General Contractors and Subcontractors who are bidding projects including projects for Cherokee Nation Entities.
- Participates in all Bid Opening meetings with appropriate parties.
- Plays an active role in Bid Openings and ensures all parties from Cherokee Nation Entities are present and TERO certification is confirmed as needed.
- Reconciles all procurement information according to policy and procedure.
- Actively participates in De-Scope meetings and ensures vendors are thoroughly vetted.
- Observes bids submitted by vendors and compares components ensuring all necessary and requested information is provided and seeks clarification and further information as needed.
- Assists in the development and implementation of appropriate policies and procedures.
- Conducts regular audits to identify potential weaknesses and situations involving compliance.
- Reports to management regularly concerning the organization's compliance with laws and regulations.
- Acts in dealing with situations involving compliance and creates realistic plans to overcome them with reasonable and achievable solutions.
- Creates and manages effective action plans in response to audit discoveries and compliance violations.
- Assesses company operations to determine compliance risk.
- Maintains compliance with all contractors on Cherokee Nation job sites according to TERO Law enacted by Cherokee Nation Tribal Council.
- Maintains and updates contractor files based on required TERO documents submitted weekly to remain in compliance per TERO law.
- Completes data entry for fiscal year utilizing numbers based on contracts and purchase orders. Invoices TERO fees for the duration of job through completion.
- Maintains TERO Job Bank for new applicants.
- Refers clients to contractors for direct job placement of native applicants for consideration.
- Performs referral follow-ups with clients.
- Performs on-site monitoring of job sites for compliance checks to ensure procedures are being implemented and reports any inconsistencies to Manager accordingly.
- Issues permits to employees on-site for monitoring purposes. Maintains and up-holds compliance on both tribal and federally funded jobs according to the Davis Bacon Wage Act.
- Verifies by county that prevailing wages are met on federal jobs.
- Enforces TERO Law on all Cherokee Nation sites and Cherokee Nation Entities.
- Creates monthly reports for Tribal Council.
- Creates quarterly reports for EEOC.
- Follows Cherokee Nation Procurement policies and procedures.
- Other duties as assigned.
