Litigation Counsel

The TMX Finance® Family of Companies is looking for a Litigation Counsel to join our team and perform a wide range of legal functions, such as handling pre-suit matters, managing litigation matters (e.g. defense of consumer claims, defense and prosecution of B2B disputes, and some employment litigation) and outside counsel, drafting responses to regulators, and, as needed, perform various other legal tasks, such as legal research and legal projects. You will work with a talented and sophisticated group of legal professionals (known as the “Escalations Team”) to perform these job duties. You will use your strong attention to detail and the ability to prioritize deadlines, to execute multiple legal tasks, drive strategic and aggressive litigation strategies, and consider business impacts when handling any legal matter. You are a self-starter and can work well under pressure, both independently and as part of a collaborative team. Some travel (domestic) may be required. The position is based in Savannah, GA, relocation assistance is available.

Responsibilities

• Investigate claims and develop sophisticated and complex case strategies, partnering with outside counsel to execute such strategy.
• Manage outside counsel in relation to certain complex legal matters (lawsuits, arbitrations, and legal projects) and associated spend.
• Drive cases and outside counsel in a sophisticated and aggressive manner in such a way to accomplish a “win” for the business.
• Review and edit pleadings, review, revise, and complete discovery, performing legal research as necessary, interview, and prepare witnesses for depositions and trial, and negotiating settlements.
• Assist members of the Legal Department in administration of various litigation and corporate matters, discovery projects, document review, and legal research on a variety of issues, including compliance and regulatory matters.
• Respond to pre-suit matters, including attorney letters, customer complaints, and regulatory responses.
• Assist legal management in the development of policies and procedures to mitigate corporate risk.
• Support other members of the Escalations Team and the other members of the Legal Department, as needed. 
• Build relationships with corporate and field business partners to offer strategic solutions.

Qualifications

• Minimum 3 years relevant legal experience
• Membership in good standing in at least one state bar in U.S. required
• Litigation experience required (commercial or consumer finance litigation experience preferred)
• Proficient with the Rules of Civil Procedure
• Proficient with legal research databases, such as Westlaw
• Ability to research in a thorough and effective manner
• Impeccable, clear, and concise communication, both written and verbal
• Strong attention to detail
• Strong factual and legal analytical abilities
• Ability to interact effectively with individuals of varied backgrounds and skill levels
• Comfortable with aggressive and proactive legal strategies
• Ability to problem-solve with creative and innovative strategy
• Ability to maintain positive attitude in the face of adversity
• Ability to maintain confidentiality
• Must be proficient in Microsoft Office Suite
• Work in a collegial, fast paced, environment
• Willing to learn and grow by being a self-starter and accepting constructive feedback from anyone who offers such feedback
• Desire to be part of a fun loving, hardworking, fast paced team of legal professionals who enjoy working with each other
• Physical demands for this position frequently include: the ability to remain in a stationary position, move about freely inside and occasionally outside of the office, and the operation of mechanical controls, such as a keyboard.

• Experience reviewing contracts
• Experience in employment law
• Experience in bankruptcy
• Some knowledge of business operations
• Experience with arbitration proceedings
