House Bill 2102 has made it illegal for roofing companies and other contractors to promise rebates for all or part of the deductibles or to waive an insurance deductible. Violators could receive 180 days of jail time and up to a two thousand dollar fine.

Texas law requires that a person insured under a property insurance policy to pay any deductible applicable to a claim made under the policy. It is a violation of Texas law for a seller of goods or services who reasonably expects to be paid wholly or partially from the proceeds of a property insurance claim to knowingly allow the insured person to fail to pay, or assist the insured person’s failure to pay, the applicable insurance deductible.

A homeowner can use ACV money to off-set some of their deductible. Waiving deductibles without ACV/RCV money is not allowed on any insurance inspection agreements. A homeowner may elect to have a cash contract agreement; however, the independent contractor cannot tell the homeowner that the insurance will fully pay for their roof . The Roof Inspector Specialist must ask the homeowner what their deductible is and can they afford to pay it.

Non-Compete Agreement

Independent Contractors are responsible for their own clients. The client becomes “ mutual ” to Safe and Secure Roofing and Construction LLC as soon as they have had inspection done, sign any contracts, or receive any estimates from Safe and Secure Roofing and Construction LLC. The Independent Contractor cannot take any of their clients to another roofing company or contractor soon as the clients are deemed “ mutual .” If an Independent Contractor does, they are immediately terminated and may be sued to collect damages due to loss of work and negligence. If an Independent Contractor becomes terminated, they or their future businesses cannot use any of Safe and Secure Roofing and Construction LLC subcontractors for any work for as long as Safe and Secure Roofing and Construction LLC is in business. If an Independent Contractor uses Safe and Secure Roofing and Construction LLC subcontractors, they may be sued and forced to pay damages at the $20,000.00 breach of agreement fee for each job (even if it wasn’t profitable), owed commissions to the company, pay for legal fees, and pay on damages for negligence.

Safe and Secure Roofing and Construction LLC has the right to add or remove items to the independent contractor and employee agreement at any time. Independent contractors and employees can be terminated at any time for any reason. If a job has been started by an independent contractor, they will still get paid out once a job has received all the money from that job if the independent contractor did not break the non-compete agreement.
