Litigation Associate Attorney

Wilhite and Associates Law Firm, P.C.
Carmel, IN Full Time
POSTED ON 4/7/2026
AVAILABLE BEFORE 10/4/2026

Founded in 1994, we are a “boutique” law firm, which means a small team (8 now including 2 attorneys) serving large national/regional clients within one industry (multi-family housing for us). Our focus is civil litigation and adversarial matters while also providing substantial client assistance in regulatory matters, leasing, Landlord-Tenant law and Fair Housing compliance. Our size allows us to remain nimble and aggressive to serve a large and loyal (most clients date back decades) client base. Our practice is multi-jurisdictional, but our office is in Carmel. We’ll strongly prefer Hamilton County applicants (or very quick commute).

Our team is empowered to succeed. We offer comprehensive and continued training to ensure everyone has the necessary tools, including extensive one-on-one sessions, process workflows. The firm is collaborative, including encouraging routinely communicating, brainstorming, and seeking guidance and ideas from colleagues.

The firm’s “Play To Win” brand is not just some marketing idea. It is in fact the instinctive culture of the firm. We represent demanding sophisticated clients who expect us to litigate aggressively, often in complex challenging matters. We take the cards dealt and find a way to win with them.  We don’t give up.  We don’t accept “No”, “It can’t be done”, or “That’s never happened before” as answers.  We are creative.  Everything we do has a purpose as part of a conscious strategic plan.  We have the will not only to win, but also the will to prepare to win.  Yes, just like the famous Apollo 13 line, our attitude is “failure is simply not an option.”

Cases will include litigation matters in Indiana, Kentucky (where principal is also licensed), and other jurisdictions regularly admitted Pro Hac Vice for national clients. Forums the attorney will appear in include Marion County Township Eviction Courts, County Courts including Marion Superior, Howard, Hancock, Boone, Allen, Miami, Grant, Delaware, Hendricks, Wayne, Johnson, Bartholomew, Monroe, Hamilton, Vigo, Knox, Tippecanoe, Vanderburgh, Warrick and others; H.U.D. and State and local Civil Rights Commissions.

Onboarding begins with exposure to hearings, mediations, and depositions first observing the firm’s approaches, sharing the responsibilities, taking the lead with the principal’s presence, then appearing alone. The timeline for that transition is unique to the attorney’s experience and mutually agreed progression. If prior experience is limited, that progression might take 6-9 months. If prior experience is substantial, that progression might take just a couple of months. While the goal is to complete that progression as soon as possible, the overriding commitment is make sure the attorney is fully supported and prepared.

The attorney will receive significant litigation and trial skills development. The firm’s principal has been a successful civil trial attorney since 1984 with substantial jury trial experience. He has been a Board-Certified Trial Attorney, National Board of Trial Advocacy and been on the faculty for the National Institute for Trial Advocacy. He authored a Trial Evidence CLE for ICLEF. Wanting to be a persuasive litigator, his bachelor’s degree in psychology was followed by social sciences training and teaching on principles of persuasion, both face to face to Judges and Juries and written communication. The firm regularly reinforces strategic principles like primacy and recency and K.I.S.S. (Keep It Simple Stupid). Whether in a trial or a written argument, the firm teaches that all decisions are made as part of an overall conscious strategic plan.
