Description
Renders legal advice and assistance to all system universities and to UH System and its component universities. Serves as a higher education legal generalist for the UH System and its components.
- With direction from General Counsel, provides all UH system health components with transactional, regulatory, and operational legal guidance and representation on health care matters affecting the University of Houston System's health related colleges and health care clinics.
- Advises on federal and state health care laws and regulations, including privacy laws (HIPAA, HITECH, 21st Century Cures Act, FERPA), the Stark law, the Anti-Kickback Statute, and the False Claims Act, state licensure laws, and other applicable compliance requirements.
- Provides counsel on Medicare/Medicaid reimbursement and other medical billing issues.
- Drafts and reviews health care policies, procedures, and consent forms to ensure compliance with relevant federal and state statutory and regulatory requirements.
- Drafts, reviews, and analyzes health care-related contracts including, but not limited to business associate agreements and data use agreements.
- Serves as the health care compliance professional within the Office of Compliance and Ethics, providing oversight and guidance under the University of Houston System's health care compliance program supporting the College of Medicine, College of Optometry, College of Nursing, College of Pharmacy, system clinics, and other health care operations.
- Assists the System Chief Compliance Officer with the implementation, maintenance, and operation of the health care compliance program.
- Assists in evaluating the effectiveness of the health care compliance program and recommends revisions as needed based on organizational needs, changes in law, and third-party payer policies and requirements.
- Provides compliance-related training on health care laws, regulations, and policies affecting the System's health care operations and activities.
- Collaborates with the Office of General Counsel, the Office of Compliance & Ethics, and Internal Audit in responding to alleged violations of rules, regulations, policies, and procedures.
- Assists in identifying compliance risks across health care operations and activities, assessing necessary controls to mitigate such risks, and evaluating the effectiveness of such controls.
- Performs other job-related duties as assigned.
