Construction Law Litigation Attorney

We are seeking a Construction Law Litigation Attorney with 6–10 years of substantive commercial litigation experience, including experience in New York State courts, to join a growing practice. The ideal candidate will have significant experience with construction disputes, commercial contract litigation, and complex business claims, and will independently manage matters from inception through trial, settlement, arbitration, or other final resolution. This senior-level attorney will take ownership of complex matters, exercise sound legal and business judgment, develop effective litigation strategies, advocate skillfully, negotiate favorable outcomes, and provide practical, results-oriented advice while maintaining strong client relationships.

Responsibilities

• Develop and implement comprehensive litigation strategies from case inception through final resolution.
• Analyze potential claims and defenses, contractual obligations, and litigation exposure.
• Draft complaints, answers, counterclaims, cross-claims, third-party complaints, motions, and other court submissions.
• Develop and execute discovery plans, manage document discovery, conduct and defend depositions, and prepare witnesses for testimony.
• Draft and argue dispositive motions, discovery motions, and other substantive applications.
• Handle court conferences, hearings, oral arguments, and other litigation proceedings independently.
• Review and analyze contracts, project records, financial information, payment claims, delay and disruption issues, and other complex commercial documentation.
• Draft, review, and negotiate commercial contracts and related agreements, advising clients on contractual rights, obligations, and risks.
• Evaluate damages, litigation exposure, and potential outcomes; formulate settlement strategies and negotiate favorable resolutions.
• Represent clients in mediation, arbitration, evidentiary hearings, and trial proceedings.
• Maintain regular client communication regarding case developments, strategy, risks, costs, potential outcomes, and recommended courses of action.
• Manage litigation schedules, discovery obligations, court-ordered deadlines, and procedural compliance.

Required Qualifications

• 6–10 years of substantial commercial litigation experience, including experience in New York State courts.
• Significant experience handling construction disputes, commercial contract litigation, and complex business claims.
• Demonstrated ability to independently manage cases through all phases of litigation, from initial pleadings through trial or resolution.
• Extensive experience taking and defending depositions.
• Excellent legal research, analytical, drafting, and writing skills.
• Strong motion practice and oral advocacy experience, including dispositive motions and discovery-related applications.
• Exceptional negotiation skills and sound legal and business judgment.
• Ability to analyze complex factual records, financial information, project documentation, and contractual relationships.
• Strong organizational and time-management skills, including the ability to manage multiple matters, competing priorities, and critical deadlines.
• Excellent interpersonal, communication, and client-management skills.
