The Town of Falmouth seeks an experienced, highly motivated, creative attorney to serve as the Associate Town Counsel in the Town’s Law Department. Town Counsel’s Office provides legal advice and advocates for the Town of Falmouth, its boards, departments, officers, and elected officials in all areas of municipal law.
Falmouth’s coastal and natural resources attract and support a vibrant, responsive, and responsible community. Under the general direction of Town Counsel, the Associate Counsel plays an integral role in supporting the Town in its pursuit of protecting these resources while promoting sensible and sustainable growth and providing safe and reliable services. Associate Town Counsel works closely with Town officials, providing legal support and advice in the areas of land use, zoning, planning, building, health code enforcement, affordable housing, and real estate. An inspired and thoughtful approach to municipal land use is instrumental to the Town’s ability to create affordable housing, provide long-term solutions for clean water, and craft achievable plans for the future of the Town’s beaches, tidal waters, forests, and open space.
Associate Town Counsel drafts and reviews leases, easements, deeds, mortgage and loan documents, and general contracts and performs other work as needed to support Town Counsel. The position represents the Town and its boards in litigation before all courts and tribunals and provides counsel at day or evening public meetings of various Town boards or committees, including the Zoning Board of Appeals, Planning Board, Historical Commission, Board of Health, and the Conservation Commission, among others.
Minimum Qualifications: Juris Doctor degree; active member of the Massachusetts Bar; admitted to the Massachusetts Federal Courts or eligible for such admission; at least five years of experience practicing law, preferably in the area of municipal law.
The ideal candidate has exceptional legal research and writing skills, the ability to communicate effectively and professionally in public and with the public, and an aptitude for being able to find a pathway to resolution. Candidates should have a keen interest in public service and a desire to work on a collaborative team.
Some remote work may be an option after successful completion of the probationary period. A modest one-time relocation stipend may be available for the right candidate.
Expected Starting Salary Range: Step 1 ($111,592) – Step 8 ($141,044.80), commensurate with qualifications and experience, with room to advance along the 10-step pay scale. Comprehensive benefits package, including 13 paid holidays per year, vacation/sick/personal paid time off; Town contribution of up to 75% of the cost of health insurance; cost-effective dental, vision, life insurance, and disability policy plans, enrollment in the defined benefit pension plan, voluntary pre-tax and Roth 457(b) plans, and opportunities for professional development.
