About State Grand Jury Prosecution

The job of a State Grand Jury Attorney is a unique prosecution position. State Grand Jury prosecutors work closely with the South Carolina Law Enforcement Division (SLED) and other state, local, and federal partners to develop complex investigations into such subjects as cartel drug trafficking, public corruption, complex white-collar matters, and gang violence. State Grand Jury prosecutors use the power of the State Grand Jury to compel witnesses to testify and to subpoena different types of evidence to develop these complex investigations before indictment. Once a case is indicted by the State Grand Jury, a prosecutor in the division is then responsible for resolving the cases from his or her investigation in general sessions court, whether by plea or jury trial. The job of a State Grand Jury prosecutor is also unique in that no cases automatically come to the State Grand Jury – prosecutors have autonomy in identifying criminal problems in the State that need to be fought and then developing cases before the State Grand Jury to do so.

 Under limited supervision, your job responsibilities may include:
  • Advising and assisting law enforcement officers regarding possible criminal violations; reviewing case reports; advising and assisting law enforcement in State Grand Jury (SGJ) investigations. Preparing and presenting cases for SGJ consideration; preparing and presenting indictments where appropriate in the SGJ. Handle all necessary litigation and process to facilitate and complete the SGJ investigation.
  • Preparing SGJ criminal cases for disposition, whether by trial, plea, diversion, or dismissal; making court appearances on behalf of the State of South Carolina in SGJ cases; preparing and responding to discovery requests and motions; conducting all litigation related to the disposition of SGJ charges; manage an SGJ caseload.
  • Preparing general criminal cases for disposition, whether by trial or plea; making court appearances on behalf of the State of South Carolina in general prosecution cases; preparing and responding to discovery requests and motions; conducting all litigation related to the disposition of general prosecution charges; manage a general prosecution caseload.
  • Handling Civil Forfeitures for SGJ and Prosecution.
  • Handling miscellaneous matters as assigned by the Attorney General, Chief Deputy, or Chief of the State Grand Jury division.

A juris doctor degree or its equivalent from an accredited law school and a minimum of five years as a practicing attorney.

Necessary Requirements: The applicant must be in good, active standing with the SC Bar and have satisfied Rule 403 requirements before the start date.

Additional Requirements:
  • Employee is expected to inform supervisor of any issues, problems, or suggestions relating to job duties.
  • Position may require overnight travel.
  • Position may be required to travel and transport files.
  • Must be organized and able to work independently in meeting deadlines. 
  • Requires excellent written and oral advocacy skills.
  • Must have excellent criminal court experience.

DRUG SCREENING, CREDIT CHECK, DELINQUENT TAX CHECK, SLED BACKGROUND CHECK, AND GRIEVANCE CHECK REQUIRED.
