Position Overview
The Process Server is responsible for delivering legal documents to individuals and entities in accordance with state and local laws, court rules, and company standards. Process Servers serve as a critical link in the legal process and must uphold the highest standards of conduct while representing Process Server One.
This position involves extensive fieldwork, independent scheduling, and direct interaction with defendants, witnesses, tenants, business representatives, and legal professionals. The ideal candidate is reliable, detail-oriented, self-motivated, and capable of handling sensitive situations calmly and professionally.
Key Responsibilities
Service of Process
- Serve legal documents, including summonses, complaints, subpoenas, notices, writs, and other court-related papers
- Ensure all services are completed in strict compliance with applicable laws, regulations, and court rules
- Verify recipient identity when required and confirm service details accurately
- Execute service attempts within required timeframes and deadlines
Field Work & Investigations
- Conduct multiple service attempts at residential, commercial, and government locations
- Perform basic skip tracing and address verification when necessary
- Document all service attempts accurately, including dates, times, locations, and observations
- Use professional judgment to determine the most effective and lawful service approach
Documentation & Reporting
- Complete detailed and accurate affidavits or proofs of service
- Submit service results, notes, and documentation promptly through company systems
- Maintain accurate records for all assigned jobs
- Communicate unsuccessful service attempts clearly and provide recommendations when applicable
Professional Conduct & Client Representation
- Represent Process Server One professionally in all interactions
- Maintain neutrality and avoid providing legal advice or personal opinions
- Handle difficult or uncooperative individuals calmly and respectfully
- Maintain confidentiality and discretion at all times
Time Management & Organization
- Manage daily routes efficiently to maximize productivity
- Meet service deadlines and priority requirements
- Communicate scheduling conflicts or delays promptly
- Maintain availability for rush, same-day, or time-sensitive assignments as required
Compliance & Safety
- Follow all company policies, legal guidelines, and ethical standards
- Adhere to safety protocols while working in the field
- Avoid trespassing, harassment, or unlawful conduct
- Report safety concerns or incidents immediately
Court & Filing Support (If Applicable)
- File documents with courts or government agencies as assigned
- Retrieve filed or certified copies when required
- Ensure proper filing procedures and obtain confirmations
