Roles And Responsibilities
- Assists the Senior Director, Contracts and Claims with the negotiation of complex contracts required to implement capital projects.
- Drafting of agreements with commuter and freight railroads required for major capital investment projects and NJ TRANSIT’s capital program.
- Evaluates and ensures compliance with State and Federal requirements affecting CP&P.
- Analyzes and comments on the implementation of State and Federal statutory proposals and requirements.
- Reviews and facilitates CP&P’s positions on real estate transactions for use of NJ TRANSIT rail properties by railroads and other third parties.
- Draft and negotiate power sharing and power transfer agreements with public utilities, railroads and third parties.
- Reviews contracts including indemnification and insurance issues between third parties, including other railroads, public utilities, municipalities and other transportation agencies.
- Drafts agreements with third party entities such as utilities, public entities and other public agencies/authorities as required carrying out the work of CP&P projects.
- Monitors the collaboration with the Risk Management, Procurement, Real Estate, Environmental and legal liaisons within and outside NJ TRANSIT on behalf of CP&P to implement capital projects.
- Assists with the negotiation of Rights-of-Way (ROW) and railroad acquisitions and potential condemnation of property.
- Assists in the formulation of the standard RFP provisions for design and construction contracts including the scope and technical approaches necessary for the design, construction and ROW acquisition for CP&P projects.
- Prepares materials for training sessions for NJ TRANSIT staff on contracts, environmental matters, real estate and title issues, indemnification, etc.
- Baccalaureate Degree in Liberal Arts, Business Administration or related area or equivalent and three (3) years of applied experience in the drafting and negotiation of public construction and railroad agreements.
- The ability to analyze and interpret complex contracts, statutes and regulations, including environmental and utility regulations, is desired. Strong verbal and written communication are required.
- Juris Doctor strongly preferred and may be substituted for three (3) years of applied experience.
- Three (3) years of applied experience in the drafting and negotiation of public construction and railroad agreements.
- The ability to analyze and interpret complex contracts, statutes and regulations, including environmental and utility regulations, is desired.
