Overview: Responsible for all aspects of an assigned problem Equipment Finance loan portfolio with group credits of up to $20 mm or more, to protect the Bank against losses and ensure an effective and efficient outcome. Administers the turnaround or exit of the most complex credit relationships through restructurings and forbearance agreements which may include providing ongoing financing or the liquidation of the borrower. May assist in specific portfolio responsibility for most complex workout deals. Primary Responsibilities: Obtain, spread, and analyze borrower and guarantor financial statements, projections, and 13-week cash flows to measure and monitor the customers’ performance and adherence to covenants within existing governing documents and underwrite any restructurings or forbearance agreements. Prepare debt service overlays to measure customer ability to pay future maturing term obligations. May review work products completed by less experienced personnel for accuracy and effectiveness as required by management. Coordinate monthly portfolio review to ensure appropriate risk grading, accrual status, and progress with workout transactions; maintain all updated collateral values and recommend charge-off processing. Lead, train, and serve as mentor to less experienced staff. Support management in assigning and organizing department workflow. May negotiate end-of-lease terms and buyouts. May work with internal and external equipment remarketers to recover and market off-lease or repossessed equipment. Work with attorneys to complete the article 9 sales process per Bank policy, while managing costs. Measure and recommend probability of default and loss given default upgrades and downgrades to measure the risk of an assigned portfolio of workout credits. Prepare and submit risk rating change forms to senior management as required to ensure proper rating. Measure and test covenant compliance in accordance with customer loan documentation; in cases of failed tests, negotiate resolution with customers with management approval. Request and review default documentation audits. May support management in working with internal and external auditors during loan review exams. May assist and response to audit and compliance inquiries. Work with, and may engage, internal and external counsel as appropriate throughout the oversight of a relationship, including participating in Bankruptcy, state and/or Federal court proceedings. Present and discuss all eligible relationships along with action plans to senior management in regular strategy meetings and quarterly problem loan resolution meetings and run established internal and external delinquency reports as required. Manage a portfolio of fully charged-off loans and leases to recover funds through legal means with the support of outside counsel. Work closely with other department personnel, financial institutions, insurance companies, turnaround consultants, and vendors that may be relied upon to provide information on the portfolio. Represent the Bank in civic and community activities. Understand and adhere to the Company’s risk and regulatory standards, policies, and controls in accordance with the Company’s Risk Appetite. Identify risk-related issues needing escalation to management. Promote an environment that supports belonging and reflects the M&T Bank brand. Maintain M&T internal control standards, including timely implementation of internal and external audit points together with any issues raised by external regulators as applicable. Complete other related duties as assigned. Scope of Responsibilities: The financial statements the position works with are of varying complexity and may include publicly traded companies. The relationships handled by the position include, but are not limited to, direct relationships, syndicated credits, and participations. Supervisory/Managerial Responsibilities: Not Applicable Education and Experience Required: Bachelor's degree in Finance, Business Management or related field and a minimum of 5 years’ workout and/or credit experience, or in lieu of a degree, a combined minimum of 9 years’ higher education and/or work experience, including a minimum of 5 years’ workout and/or credit experience Strong verbal and written communication skills Strong presentation skills Strong problem-solving skills Strong analytical skills Strong negotiating skills Proficiency with personal computers as well as pertinent word processing, spreadsheet, and industry-specific software Strong decision-making skills Education and Experience Preferred: Proven work leadership skills Specialized knowledge of debt collection practices including legal aspects, loan structuring and equipment leasing industries Ability to handle escalated situations Ability to spread and understand corporate and personal financial statements and tax returns Knowledge of US Bankruptcy Law Knowledge of Article 9 sales process Ability to manage multiple priorities Ability to work independently and use own discretion Ability to prioritize work #LI-LA1 M&T Bank is committed to fair, competitive, and market-informed pay for our employees.
