The Claims Manager is a specialized role responsible for leading, managing, and tracking all auto liability accidents, property damage, and Workers’ Compensation claims. This position ensures efficient investigation, resolution, and recording of claims, whether they are handled by a third-party insurance carrier or managed in-house. The role is critical in mitigating financial risk, reducing litigation exposure, and acting as the primary point of contact with various insurance partners, brokers, and claims adjusters. The Claims Manager influences the defense posture of claims and provides essential support to the Director of Safety in litigation matters.
KEY RESPONSIBILITIES
I. Accident & Liability Claims Management (Core Focus)
- Lead and manage the entire claims lifecycle for auto liability, property damage, and cargo claims, working with the Director of Safety for complex claims.
- Subrogation Management: Pursue and manage the subrogation of claims to recover losses from at-fault third parties and maintain reporting for active metrics.
- Claims Investigation Initiation: Initiate the investigation of accidents by assigning appropriate external adjusters, using outside investigators, or assisting in lay-person determinations.
- Accident Preservation: Immediately after an accident occurs, gather all necessary accident preservation items, including driver statements, photos, and police reports.
- In-House Claims Handling: Act as an in-house adjuster for claims handled independently, setting reserves, determining liability, and negotiating settlements within established authority limits.
- After-Hours Emergency Response: Serve on a rotating basis to take serious accident and injury emergency calls only after hours, acting as a liaison with the driver support department.
- Manage Post-Accident Logistics: Coordinate towing, hazardous spill cleanup (e.g., diesel fuel), and work with maintenance to determine if post-accident drug and alcohol testing is required.
- Coordinate Repairs: Work with maintenance team to coordinate repairs of damaged equipment, request estimates and place/remove holds for litigation on equipment.
- Equipment Scheduling: Adjust and maintain the list of insured equipment and their associated values for the physical damage schedule.
II. Workers’ Compensation Claims
- Manage Workers’ Compensation Claims: Maintain and monitor all new and existing Workers’ Compensation claims, including coordination of light duty work.
- Research and Documentation: Aid with research and data collection and documentation for processing claims, including gathering information for pay rates, and denial determinations.
III. Insurance Partner Relations
- Manage Claims Fees: Manage claims fees and communicate with TPAs, account managers, brokers, and claims adjusters.
- Certificates of Insurance (COIs): Obtain, distribute, and maintain Certificates of Insurance (COIs) issued by the company and received from vendors, contractors, and other required parties.
- Risk Evaluation: Utilize free consulting opportunities and evaluate additional risk management strategies offered by insurance partners.
III. Litigation Support, Auditing, and Compliance
- Litigation Support: Assist the Director of Safety (not the primary contact for defense counsel) in the preparation of responses for requests for production and answering interrogatories.
- Influence Defense Posture: Provide expert analysis and input on the claims and investigation data to influence the overall defense posture of litigated claims.
- Records Custodian: Act as the records custodian of all claims files, ensuring secure storage of highly sensitive and confidential information while maintaining system integrity.
- Audit and Analysis: Conduct claims auditing for trends and perform root cause analysis to identify patterns and recommend corrective actions.
- Records Compliance: Maintain all required OSHA and DOT recordkeeping for accident registers and D&A programs following an accident.
- Data Input: Input all required data into claims management systems for accidents, Workers' Compensation, and other incidents.
- Assists in educating: the Driver Support staff offering feedback on accident report completion weekly.
- Tracking and Monitoring: Assist Director of Safety with development and management of a new tracking tool for monitoring claims.
QUALIFICATIONS
- Proven experience in commercial transportation claims management or as a licensed claims adjuster is highly preferred.
- In-depth knowledge of auto liability, property damage, and Workers' Compensation claims best practices, including subrogation.
- Strong analytical skills for auditing and root cause analysis.
- Excellent negotiation, communication, and organizational skills.
- Must be able to handle highly sensitive and confidential information.
