Position Overview
Malman Law is seeking a motivated Pre-Litigation Associate Attorney to manage personal injury cases from intake through settlement negotiations prior to the filing of a lawsuit.
This role is ideal for an attorney who is client-focused, highly organized, and skilled in case development and negotiation. The Associate will work closely with clients, medical providers, insurance carriers, and internal teams to resolve cases efficiently while maximizing client outcomes.
Key Responsibilities
Manage an assigned caseload of personal injury matters through the pre-litigation phase
Conduct client intake interviews and maintain consistent communication throughout the case lifecycle
Review and analyze medical records, bills, police reports, and supporting documentation
Track client treatment progress and damages to support accurate case valuation
Prepare comprehensive settlement demand packages
Negotiate settlements with insurance adjusters under attorney supervision
Coordinate with medical providers, experts, and vendors as needed
Maintain detailed and accurate case records within SmartAdvocate
Ensure compliance with internal deadlines and firm protocols
Collaborate with litigation attorneys to transition files when litigation becomes necessary
Participate in team meetings and strategic case discussions
Qualifications
Juris Doctor (J.D.) from an accredited law school
Licensed and in good standing with the Illinois Bar
3–5 years of personal injury experience preferred
Strong written and verbal communication skills
Demonstrated negotiation and analytical ability
Ability to manage a high-volume caseload in a fast-paced environment
Client-centered approach with professionalism and empathy
Experience with SmartAdvocate or similar case management systems preferred
Litigation experience a plus, but not required
Compensation & Benefits
Base Salary: Starting at $110,000 annually
Final compensation will be determined based on experience, qualifications, and alignment with firm compensation structure.
Performance Bonus: Eligible for a 1% bonus on gross settlements, subject to firm policy and eligibility requirements
Firm-funded 401(k) contribution equal to 3% of salary (regardless of employee contribution)

Work Environment
Full-time, on-site position (Monday–Friday)
Occasional travel for client meetings may be required
